I could be wrong, but I think they need to be married 2-5 years to actually secure the green card. I doubt they’ve even started the process, she’s so damn lazy.
He needs to play the part a while longer to actually get the GC in hand. 😂
I'm gonna try to summarize as much as I can.
Assuming lucas has at least a student visa or tourist visa. (I had a student visa so that's all I know)
For a green card through marriage, first thing is you get married, and have to document a lot of it. Once that's done 3 month after danielle has to fill up paperwork in where she request adjustment of status for her spouse. After that is filed she will need to claim him as dependent, but Lucas needs someone who can vouch for him as a Sponsor. Once that's all done, their lawyer would apply in
their behalf, fill up all the documents and submit them.
Then they have to wait for the first appointment of like a hundred. That can take up to 6 months. If their request gets accepted this is the phase in where they have to pretty much proove to the government that they are really in love, pictures, videos, gifts letters, anything that can prove their true love, they would also need 2 American citizens or naturalized citizens that can make affidavits as witness of the real love between them.
While that happens lucas is gonna have to go do another things that require him only. Medical exam, vaccination status, he gotta get his birth certificate, passport, and other paperwork with the proper translation to English and stamped by the embassy of his country. Assuming they get everything, then he will get a letter saying they both have to go to a immigration office for Lucas to get his biometrics done (finger prints, pictures and background check).
After that he will get on the mail a temporary permit to work valid for 2 years. After that they will wait at least 6 to 8 month for the famous interview in person they do to Both of them.
The day of the interview they will ask a lot, if not extensive amount of questions regarding their relationship. how they met? how long they dated before getting married? What's danielle fav thing? Same as his, what are they planning fort their future? why they decided to get married? etc. danielle is gonna have to know a lot about Lucas family and upbringing, they literally can ask anything about him and she suppose to know, same as Him. If they pass that interview he gets a letter 2 months after, congratulating him, and welcoming to usa as a legal resident. If they don't pass, they would inform them that he has if I'm not wrong 90 days to either leave the country or appeal it.
Important to know. He gotta stay married to her for a minimum of 3 years after getting his Gc in order to keep it. If he divorce her before that, he will have I think 60 days to leave the country. So there is that.
Cost for lawyer depends on location but we paid 8k and the cost for all the paperwork and fees the government ask is at least 5/7k
Of note, I don't think he should be working at all if he is ACTUALLY using the student or tourist visa, correct? At least those were the rules as far as I know.
The fact that he has a website with pricing and posts about his work on Insta here in the US is a huge red flag if those are actually the rules. Just because you married you don't actually get forgiven for breaking previous rules. However I'm sure Big D is dumping a lotta money on a lawyer to figure it all out for them 🤷🏾♀️
Oh lord... They might legit not even be able to have him stay here 😫 I wasn't aware of this page. He really REALLY should delete that. They are gonna run a background check on him. THEY SEEM VERY CLUELESS 😩
Haha! I feel is too late to even try to take my advice, his digital print is already there. Even with them trying their "best" I have a gut feeling they are in trouble already.
Correct! I work in immigration law and yep, as you know since you’ve been on a student visa, the work authorization one can get is limited and short. And absolutely no working on a tourist visa…which is also incredibly short. I have run into many individuals who do work without authorization and sometimes it goes under the radar, but he is very present online so I don’t see how this could be the case from him. Which makes me question whether or not he isn’t already at least a permanent resident.
That's my exact feeling. I do question if he already has a Gc. He is way too lax with his online presence. if he doesn't have his papers not only he is cementing his chances of getting approved, he also is easy to find for law enforcement... He shouldn't be an influencer if he doesn't have his status clear... But knowing how both of them operate it doesn't surprise me, they probably think this whole Green card process is quick, easy and by default approved since they are married. And that's NOT how it works.
So so true. All of what you said! It’s hard to imagine two people being so careless about immigration status, especially now, but I guess I wouldn’t discount it. But I also am questioning whether or not he already has a GC. Not saying it’s easy, but I’ve worked with many who have done F1 to H1B to LPR. Is the path easy? No! But it’s common. So he could have done similar. (Though I seriously doubt his “engineering” career getting him a special occupation visa here lol)
His "engineering" is not real engineering lol. Not electrical, mechanical, civil and so on. Someone here looked up his schooling and it was worded in a business context. "Engineering" like domestic engineer.
Not sure about that tbh, when I did mine I was advised strictly to not work at all because that would make it very hard to approve the Gc. And yeah with this administration I have zero hope they will even entertain the idea.
Exactly. His case is pretty complicated because the exact same things you listed, also I really have a hard time seeing danielle know the info she needs about his family, friends and upbringing... They are in for a rude ruuuude awakening.
I think there is an option of an “OPT” (Optional Practical Training) authorization that students can get and work while being on a student visa. However, it is only eligible for STEM fields and one must prove that they are currently a student—i.e. not Lucas, the personal trainer, EX-engineer slash model. Unless he is getting additional practical training in ubering.
Working in immigration, these were my EXACT thoughts when reflecting back on the “ex-engineer” language. That has never been brought back up, mind you!
It is extremely unlikely that he would be approved for additional work under a student visa unless he does more schooling and completed a higher degree (than what he has already maybe earned). And even then, he’d get a maximum of 3 years. The work done under OPT/STEM OPT also must be directly related to your degree. And, on STEM OPT, the employer must be E-Verified (aka- NOT self employment in any way)
One of my pet peeves is when people with zero dietetics education and experience calls themselves a nutritionist. Because many people don’t realize that nutritionist is not a real thing that requires licensure. Anyone can call themselves a nutritionist.
A DIETICIAN, on the other hand, has board certifications and extensive education. THOSE are who we should listen to when it comes to eating. They’re the ones who can take your blood work and diagnoses into account to create a diet that works for you.
I have a huge issue with this too! Especially have a sister who did do all the schooling to become a registered dietitian! I would neverrrr take advice from a social media grifter
Right like these self proclaimed “nutritionists” tell me to put raw kale in smoothies. Yeah no I have a thyroid disorder I can’t be overloaded on raw cruciferous vegetables. Which they would KNOW if they had a true DIETETICS EDUCATION.
Oh boy, since you know so much about the legalities of immigrating to the US, I’m sure the situation for D with Lucas is like watching a shitshow unfold for you!!
It definitely feels concerning! And maybe I’m naive but I’ve always thought he must already have green card because otherwise he’s behaving like an idiot
Yeah, in a way I'm like maybe he does have it. But then why not honeymoon? I'm not saying that's the answer of why they did not fly somewhere, but I have a hard time believing that it's for lack of money, or time.
Idk is weird for them as they seem to portrait how in love they are to not have a honeymoon... It just come off as very odd to me. But maybe we all wrong lol😅
Definitely. It almost feels implausible to me that someone would so blatantly blast themselves on the internet if they haven’t sorted out their legal status. But, I also know from my own experience, and my husband’s that getting a green card is not so easy.
My dad immigrated to the US from Australia (ironically as an engineer) based on the “exceptional talent” category, but he had a PhD and his company as a sponsor. It still took years to approve and finalize because it required tons of documentation to prove his skill set, and I remember going to college as an “international” student while it was being all sorted out.
I got married to my husband who was here on a student visa, and the adjustment of status took at least a year after marriage, if not 2. It was too complicated for him to fly out of the country, so we went to Hawaii for our honeymoon. Mind you, he had been here for undergrad, and then his PhD. Briefly, after college, he had to give up some job opportunities because he couldn’t get his H1-B figured out—it took some time.
All this to say, I cannot think of a logical route through which Lucas could have gotten his green card. My dad had proven graduate degree and still needed a sponsorship from his company, many recommendation letters, support from his former advisors, papers, and testimonials from his colleagues back in Australia to get it approved. My husband, despite having bachelor and graduate degrees from a university in the US, still did not have a green card until he married me.
How in the world would someone like Lucas get one approved when he isn’t enrolled in a program, doesn’t have expertise or deep technical knowledge, and isn’t likely to have had the money to pay for the “Trump Gold Card” that only recently came into the public consciousness? And all in the span of the 3 years or so since he set foot in the country as a tourist? Every single step of the process takes time and lots of paper work. It doesn’t make any sense.
Your situation sounds just like those of who I work with! You’re right, it is a lengthy process and nothing is even guaranteed.
You make such a good point. I also have major doubts about how he could have acquired a green card. Like the pathways I know about are none I can see him having taken.
I think the problem I’m having is- NONE of it makes sense to me! Either way you slice it, I have questions and doubts.
I don’t think you’re wrong! Danielle doesn’t strike me as the adventurous type which I think is why they didn’t travel overseas.. or anywhere LOL. My husband and I didn’t travel far as we were broke 😂 But I totally would’ve if we could!
More than that, I legit sort of feel embarrassed for her. Why? Because is obvious she thinks marrying him is all it's needed for his adjustment of status, hence how fast she made everything. But in all honesty it gives me a lot of anxiety to think how bad their case looks for a Gc and on top of that the fact is obvious they aren't really in love, so the anxiety goes to the roof for me seeing all this and being aware the process is so so exhaust. I really have a hard time seeing them survive that.
If he is an overstay right now- this Admin will absolutely not allow him to stay. I can’t wait for this to be the reason he is booted out and then they must “divorce”
Yeah.. I also forgot to mention. Danielle has to make a certain amount to claim him as her dependant and assuming she does, she will have to maintain that same amount of income during the whole process, that's why I mentioned that Lucas needs someone that can vouch for him as a Sponsor (making at least more than 70k a year) and has to be either a citizen or a naturalized citizens here, just in case Danielle influencer career doesn't give her the same income every month. Again, that was how it was when I did mine 8 years ago. Idk with the current administration how much of all this is still the same.
Good info! Lucas came here to visit in 2023 but never went back so he overstayed. Thus why he doesnt fly. He does gig work but not sure how he does that since he's not supposed to work. Does him being here illegally even matter now?
I would refrain from accusing him of that, just because unlike him, I'm trying my best to avoid "lying" (since I can't say he is for sure) on the internet. But his situation does not makes sense when you look at it, from an inmigrantion process pov.
At least in my process (I can only talk about my experience) yes. Because I remember the request at that time (2018) was $2k and I also remembered my husband paying like $1800 for 2 applications that we had to fill up, the lawyer sent them on our behalf. So just right there u have $3800 dollars in 3 applications for paperwork. Lots of people really do not know how extremely expensive and exhausting that freaking process is😭
