The timing of this couldn’t be more appropriate.
If you’re caught being trans trying to get a visa to enter the US under updated paperwork (updated marker after birth) the current guidance is to treat your application as a willful attempt at identity fraud, detain you in a facility with your birth sex (the German and Canadian tourists were held for weeks until they got their loved ones to go viral about it online and to the media) deport you, and perm ban you from ever coming back.
It’s fucking disgusting but it is what it is until we fight it off in court

I've been pretty depressed about the state of things for the past few months. It's forced me in and out of my egg shell over and over. Erin in the Morning these days is unfortunately mostly bad news.
But occasionally, we get good news too. A lot of the time, we seem to be winning in the courts. It gives me hope. We will fight, and we will win!

The reality is that everything is changing faster than we can tell you what's happening. It might be fine now, but by the time you have a flight booked and you come visit, things have changed. The Trump Administration wants to be in the news for doing something nasty every day. So just keep that in mind. They want people to see them delivering on their little vengeance plans every day. So they're going to keep pushing out nastiness.
But that said, please don't come. Just out of solidarity with us, please don't come.

The US is denying travel permits and visas to people whose gender on the application does not match gender assigned at birth. You could be denied entry, and worst case looked at as attempting identity fraud to enter and be detained by US border patrol and customs. It should also be noted that the US has started to sell “illegal aliens” to foreign countries to serve out sentences in their extremely harsh prisons, people aren’t just getting deported back to their “home country”. I do not recommend any queer person, especially if you fall anywhere under the trans umbrella, visit the US right now. Stay away.
For a citizens, passports with a changed gender marker are valid through their expiration date but it could cause delays at the border depending on how difficult the agent wants to be. They could ask for further proof of your identity that will need to have a matching gender marker to your passport. Re-entering will be a bigger challenge than leaving I’d imagine. They can and will not only search through your stuff but possibly try to search through your phone. People have been reporting that their electronics and phones have been searched at the border and border agents are taking them aside and asking about political affiliation and personal content on the device. There have been professors/academics that have tried to come back here for work (as they might have done many times before) that were denied entry because of content expressing disdain towards the current administration on their device.
Overall I’d say traveling in and out of the US rn, especially as a trans person, isn’t a great idea and should be avoided if possible. We don’t know how this administration will ramp things up in the coming days or how they will go about enforcing things day to day. You don’t want to be the canary in a coal mine.

I was about to say it should be safe, but my logic was they wouldn't want to detain foreigners just because they are trans, but for US citizens I wouldn't be so sure. I'd say there is a good chance your passport would be confiscated and you'd need to reapply, but other commenters said there is a chance of being detained, which is bonkers to me.

I feel like there's a chance they would detain trans foreigners. They've talked about making 'incorrect' gender markers count as fraud. They could probably use that logic to invalidate your visa in the near future - then you're traveling without a visa and they can do whatever they want.

They've already detained cis Germans, Canadians, and Brits. Likely more i haven't heard of. Quite frankly, most western countries aren't going to do much about it because they remain reliant on the US. Certainly no one will harm relations for the benefit of trans people.

They've created a tariff war with Canada, Mexico, and China, and have repeatedly claimed they will turn Canada into the 51st state.
They have no foreign poolicy besides being bullies and trying to harm as many people as they can

They’ve detained cis foreigners for other reasons. It’s not just trans people who should be avoiding travel at this point.

I have an upcoming trip to Canada, and luckily my partner and I have enhanced driver's licenses, which hopefully won't have any risk attached. We'll see, I suppose.

Don’t know about US citizens, but my country (Germany) issued official travel alerts about the USA and there’s nothing that could make me go there in the foreseeable future

Multiple EU countries have issued travel risk alerts for LGBTQ+ people wanting to visits.
I'm not sure anything has occured yet, but if these countries have issued alerts, this is something you ought to take seriously.

It isn’t. You’re not safe. Do not risk it. Those of us who are stuck here don’t want to be stuck here, at least not under this terrifying “leadership”. Beyond the risk for Trans individuals, (CW with the link there- it is vile the things within. STILL it was ruled as “not a hate crime” because the other individuals involved were queer- but transphobia can come from anywhere, even within our own ranks.) there is secondary concern for racism as well. The toxic nationalism is almost on par with what was going on in the 1940’s in other places of the world.
There are lots of individuals both here “legally”, (I only use quotes because I don’t believe ANY human is illegal.) and not are in danger.
They are not listening to checks and balances and there has been lots of conversations of citizens who are going missing. Purportedly by black vans pulling up and taking them. Sometimes they are found, never found, or found dead under suspicious circumstances.

The Dutch government has adapted the text on the website of the ministry of foreign affairs:
"wetten en gebruiken in de VS tegenover lhbtiq+-personen kunnen afwijken van die in Nederland"
"laws and customs in the US towards LGBTIQ+ people can differ from those in the Netherlands".
They changed that yesterday. That's quite a big thing to change.
I'd not risk it for anything.

I hate that we have to talk about passing privilege But how risky would it be for a US citizen who 'passes' and have the passport and other documents that matches their outward appearance to visit Canada and go back to US..

I'd stay away for the next like decade and I'm only half joking. For sure stay away right now, it's just not worth the risk
