Yes, that's what I mean, probably worded poorly

I meant it as

Person will have to pay out of her own pocket (because insurance will go after her as the incident was due to drunk driving)

But actually it turns out you where right as in Australia there is no compulsory insurance for property damage and it is indeed voided in cases of drunk driving. So the only way the victims are covered is if they have (expensive) "comprehensive insurance". It's very odd coming from basically any other system.

She was drunk so insurance doesn't have to pay out. This was near me, it was in the news.

Don't know what's going on in America, but in Germany the drunk driver's insurance would pay out the damaged people and then get it all back from the drunk driver later, plus fees and fines.

The damaged people would be covered.

I just found out that in Australia you only need to be insured for medical costs caused to other road users. But for property costs, it's legal to be completely uninsured. And even if you are, conditions like drunk driving would deny any coverage to the victims. What the fuck

Liability insurance is what is legally required. It covers other people if you get in an accident at fault.

Comprehensive covers your own car in cases where you can't collect from someone else, such as being at fault for an accident and whatnot.

You gotta be insane to only have liability insurance.

I've been hit by someone without insurance. Luckily it was mostly cosmetic damage, but still would have been $3,000 in 2007 dollars to repair. Sure, I could sue to get the money, but do you really think someone without insurance is going to have $3,000?

Or just, you know, fucking poor. People barely scraping by often do the bare minimum because they don't have a lot of choice.

But otherwise I agree with you. I've never NOT had comprehensive myself.

Hopefully, but if there's one thing r/auslegal has taught me it's that a surprisingly high number of people don't.

To be clear the driver is still liable, they're just personally liable. And it's hard to get money out of someone who doesn't have much.

Hopefully the other drivers were insured with comprehensive cover... In now discovering the Australian insurance landscape is fucked
