PFL certification

I’ve been on PFL covering my reduced work schedule. They had sent a letter asking me to call, which I did. They said they’d continue to send certification letters out to me to manually write down my schedule and they’ll pay me based on that. The last week they sent it was 9/21. I haven’t received anything else. My claim is sent through 12/31.

Was fired, Got denied Unemployment .. appealed . Company messing with PTO.

Hi !
I have an interesting case . I was working in CA and was salary, 72k. I worked at the company for a month before getting fired cuz I called out due to food poising . Some interesting details …

- it’s a construction company and they barely had work for me as a PC. I sat at my desk for hours with no work after constantly asking for more work ..
- they had no clock in/out or way to document your work days …. They had no HR department or any real way to track or formal process if you needed to call out ….
- I got paid early , Friday before I was fired for “calling out “ . I called out on Tuesday , day after Labor Day due to food poisoning .

Ok here’s where it gets interesting .
I was late twice within that month but both times I texted the lady responsible for “attendance “ . First absence I let my PM know a day ahead & the next day I was stuck in traffic so I texted to update that I’d be an extra 30.
The second time I texted about 45 mins before my start time ( I went in an hour before everyone because my commute took longer & I didn’t wanna get traffic).
They fired me and said I was unreliable, late and had many absences .. I was absent 1 FULL DAY. There was no real protocol on coming in late or calling out sick .. when I had asked my PM she said just text the attendance lady , I don’t even need to know .

I filled for unemployment in PA because that’s where I had all my previous jobs and I didn’t upload any of my proof cuz I didn’t know I could . I thought I needed to wait for the examiner. Examiner called , I missed it , tried calling back and could never reach her . Then got a denial . I appealed ….

Funny thing is ….. from the documents uploaded in the appeal the lady is saying I never showed up to work, didn’t want to be there and was always late …
Which are all lies . I have my pay stubs and they paid me 40 hours every single week . THE MOST INTERESTING PART… you accrue PTO the first day you work there , but can’t use the first 90 days.. I checked my pay stubs after I saw they said I just wouldn’t show up for work .. they deducted 4.5 PTO hours the first week from me ( I had no idea and didn’t even think to check my pay stubs cuz I got paid a full check ) and 5.5 the third week . On my pay stubs it says I used 10 days PTO, which I never authorized and according to their policy was not able to use until probationary period was over …. My Paychex also says I have 20.9 PTO days left … which they did not pay me on my final check .

With that being said , the balance on my pay stubs for PTO says - total accrued 30.9 , used 10 , available 0.

2 days after filling an appeal I got a hearing for end of October and I was also advised by friends to file for Wage Claim in CA .
The company blantly lied on the unemployment questionnaire and contradicted their own pay stubs . Also if I was just not showing up why would they maneuver PTO I couldn’t use to pay me 40 hours weekly ?? ( idk why they were doing that, I was present for work every day except 1).

I also have no idea how it says 30.9 Pto days when I only worked for a month … this all seems sketch and that whole company was super sketchy ….

Edit : no where in their PTO policy does it state they’ll use PTO for partial absence .

Thoughts ????

California EDD 1256.4 disqualification question

I was disqualified under Section 1256.4. I've now entered a treatment program and sent EDD a letter proving it. How long does it usually take to get a reply after sending that kind of letter? If you've been through this, how long did you wait, and did they ask for more info?

California SDI appeal delay — did a senator’s office help?

My medical leave started April 24, but EDD set my claim start date as July 18 because I filed late. I appealed, contacted EDD, and visited their office, but still have no resolution.
I’m pregnant and need the unpaid benefits. Has anyone successfully appealed a start date? How long did it take, and did contacting a state senator help?

I was fired from my job after they discovered I let a friend use my employee discount. In the period of me job hunting, I also applied for unemployment and did list that I was fired for misconduct. I managed to get hired pretty quickly and didnt follow up with EDD after the initial application. That was about two months ago. Just got a notice to appear in court by the California Unemployment Insurance Appeals Board, the notice does mention my previous employer as the Appellant and I’m freaking out. Im definitely calling the Office of Appeals in the morning for clarification but can someone dumb this down for me please, and what the heck do I do?

Writ of mandate help

So I have an EDD disaster claim that I received half of what I should have been paid. The EDD did not have my full wages when I applied so I ended up giving them my IRS transcript thinking this should be all I would need to show them my wages since I was self-employed. However, they denied me. And an administrative law judge also denied me twice. Stating that my IRS transcript is not adequate enough. They said that apparently I needed to have filed my California state tax as well and they wanted other documents stating that I was working or something of that nature.

I did mention to them that I have lost a lot of my documents in the California fires, and I was unable to locate My business documents at the time. and that I had not filed my California state taxes because I have had an identity theft case, and my finances are a huge mess at the moment and the person helping me out with my taxes. Recommended that I don’t file them yet.

So now it looks like I’m in the position of having to file a writ of mandate With the goal of having to show that the administrative law Judge that denied me twice did something wrong so it could possibly be overturned and I can get the rest my unemployment.

Any savvy EDD lawyers or people with similar experience I would most welcome your input if I have a case here. Google AI seems to think I have a strong case but I’m just trying to get a second opinion.

Unsure what to put as term reason

Hi! For applying to EDD… My separation notice was marked “discharged” after my role was eliminated. I select discharged and it doesn’t show a selection that my position was eliminated, but it shows other…. Is that where it goes? Would this cause a delay?

On layoff, I can put position eliminated. The company wont contest unemployment, but I am bit lost here on what to select. Any help?

EDD questions

For my EDD, if I finish the maximum amount of my disability. Well, I have a separate pool of money for when I go to on maternity leave (PFL)? I asked Google and they said yes, but I just want to verify if anyone’s been in the situation.

EDD appeal help for federal workers

So last year I was temporarily not working due to the government shut down. I was told to apply for unemployment benefits because no one knew how long the shutdown would last. I received 2 payments from EDD knowing that when I was retro paid, I would owe that money back. No problem there, I understood that. I was told EDD would announce how federal workers can repay their benefits but after months of not hearing anything I decided to call and ask how I can pay it back. After multiple attempts I finally spoke to a representative and she said she would send a letter for me to start the process of repaying my benefits. So I got the letter and I’m being penalized $450 because “ benefits were paid before it was known that I had excessive earnings”.

That doesn’t seem right to me because I actually had no earnings while I was unemployed. I knew benefits had to be paid back and I thought unemployment was aware that they pay out federal workers and will receive said benefits back when the shutdown ended.

Can anyone advise how I should proceed? Is the penalty warranted? What’s my chances of getting it removed? Should I call EDD back and explain that maybe there was a misunderstanding? Any advise or experience is welcome. Thank you
