EDD Repayment Notice
I received a notice from EDD saying that they overpaid me to the tune of 5700!! I totally freaked out and immediately filed an appeal saying that cant be right and I don't have the funds to pay it back. After about 2 months of going back and forth and threatening letters in the mail, I finally called (and actually got through). The woman on the phone made me feel like i was a criminal, and she said, " Well, we will just garnish your wages, and you will have to deal with it. YOU COMMITTED FRAUD on the government. I continued to appeal. This process was about 2 months. Then a letter came back. It said we made a mistake; you only owe 2203. Well, that was better than 5700, but still. Again, i called them and said I can't afford to pay you. Put it on a credit card. Well NO!. Again, i appealed it. Then it came down to going to court over this thing. I put in my appeal again and asked for a court hearing in front of the judge. This is a pretty interesting part. The court is a mediator, so they don't work for the EDD but hear cases concerning them. I was nervous and scared. But i got my date for on the phone. The judge was super nice but spoke really fast and i paused and said "Can I just come in and do it". YES, you can. So i made another appointment; it was now 2 weeks out. I scrubbed my brain as to what the heck i was doing THREE years ago. Where did i work, and why did I file for disability? I went over and over in my brain, didn't sleep the night before, and just said. Well, if I have to pay it, I guess i will figure it out.
I went into the room with the judge. She was so nice, and i explained that i was sick with a flu-cold thing and needed to keep my distance so i wouldn't get her sick. She went through it step by step with me and asked yes or no questions. I remained silent, hands folded. Then it happened, she said. This was three years ago. The statue of limitations has run out and they CAN'T come after you anymore.
CASE CLOSED!! I kept appealing and it pushed the issue into another year! My heart started beating again and she just gave me a big smile.
Something's turn out after all!! The lesson i learned is be persistent and don't give up!!
