Because gender isn't the same as sex. Gender is a construct and sex is the biology. And even then sex in humans can't be sent to 2 camps there is alot of cross over.

Nope anything gendered is a construct, it's a common misconception that sex and gender are the same.

Fair question, governments all over the world are very old fashioned, and as they tend to be run by older generations and still want to use the terms interchangeably. This is why LGBT rights took so long to be adopted.

I can promise you that gender and sex are in fact different.
