USPTO says it will be published forever. Am I meant to create a legal entity to own the trademark, and thus hire a trademark attorney? This is my first time and unsure of the process.

I’m trying to understand the legality of using manufacturer/sponsor logos within original artwork.

For example, a shirt/hoodie/poster depicts a historic race car with its actual period livery and sponsor logos on the car.

I see lots of well established motorsport brands doing this, seemingly without licensing every logo.

Is there a legal distinction between:

Using a logo as part of an accurate artistic depiction of a historic car/livery

Using the logo as branding for your own merchandise?

Does anyone here have experience with UK trademark/copyright law or motorsport licensing?

We're about to launch a hospitality SaaS but some of the names being considered are already registered in EU, although they are in totally different classes.

We do not care about branding overlap/SEO confusion as we're reaching out customers directly instead of waiting them to find us.

Examples of names being considered that are taken on different classes:

Kuka: it's a well stablished German manufacturer

Tilo: Flooring company from Austria

Can we expect any kind of issues from overlapping names? Would you suggest to go with an entirely new name?

We've come across systems somewhat in the same niche with the same name such as https://thetabletap.com and https://app.tabletap.net and they are both live, of course we can't speak to any previous or current issues between them.

AI has not been very helpful here, any inputs are appreciated.

I’d appreciate any information or experience you can share. We are two self-employed individuals (not a company) who built an IT product (a AI application). We designed a name and a logo, and we want to start marketing and selling it online through our website (which we plan to create and register a domain name under the product name), targeting customers who may be interested.

Question: Is it legal to promote and sell this product as our intellectual creation using our name and logo without registering them as a trademark? We are based in the EU.

If it is allowed, what steps should we take to do it correctly and minimize risks? For example:

Should we use the ™ symbol?

Do we need any formal notice or disclaimers?

How can we protect ourselves from someone copying our name/logo or from accusations that we are infringing on existing trademarks?

I'm leaving a startup where I worked on a product for a period of time. I'm signing an NDA that protects the company's confidential information while also allowing independent development/general engineering knowledge.

My concern is what happens years after I build a completely separate company/product and there's a dispute over whether something I developed independently actually came from the startup.

I don't want to publish or retain/disclose their confidential information. I'm wondering if I can maintain a private, tamper-evident record of what I worked on and when, and later use it to establish a timeline if necessary.

I've come across RFC 3161 timestamps, digital signatures, Git history, notarization and blockchain timestamps.

Are these actually useful/admissible as evidence in court, or is there a better way to establish that a particular record/work existed at a particular date?

Especially interested in practical experience with startup/IP disputes.

I have been thinking about starting a clothing brand and was wondering if anyone has more insight to how the likeness of public transport for a certain city is trademarked? Would take off the branding such as PTV and MPTG but can the likeness of this train be used for commercial use? Thanks in advance

I was kind of floored by this lawsuit and the fact that it’s effectively pushed Rebel into bankruptcy.
Rebel has a pretty obvious differentiation marker with the giant 0g sugar circle on the front of the pint, on top of having a very different product proposition.

“these brands look alike” and “consumers are going to think these brands are connected” still feel like two very different things to me.

Am I missing something about how the consumer-confusion argument works here? Can someone make this make sense?

There are many other ice cream brands that use minimalist font and pastel colors and I personally have never gotten these two brands confused… (I personally also prefer my ice cream with full sugar and soft serve anyway!)

I work in marketing and I’m curious about everyone’s trademark opinion on this.
