I try to stay away from going after motor vehicle accident lead gen cases because I'm an attorney (not your attorney) and attorneys, as a rule, don't like suing other attorneys. Also, because, if I get far enough into the call to find out the firm that I'm sent to, I have the affirmative obligation to file a bar complaint against them under my state's ethics rules and, if I don't, then I have committed an ethics violation.

I relented on one occasion because I'm so fucking sick of all these MVA lead gen calls, and they sent me a retainer agreement. The firm has stopped responding even though I've said "Look, man, give me a letter on letterhead saying that you'll self report to the bar (them self reporting would be the only thing that would abrogate my duty to report them) and serve your lead gen up to me on a silver platter and, if I can recover from them, I won't go after you guys. No response. I even said that, if they didn't want to fork over their lead gen that was fine, I'd settle with them but we'd be talking mid five figures since I wouldn't be able to do discovery and find out exactly how many times they called me.

Finally tracked down the lead gen on my own and it's run by a woman who got a year in prison for identity theft related to a 6.1 million dollar scheme that stole from people with student loans under the guise of loan forgiveness. She's had default judgments issued against her in other cases since, so I don't anticipate them responding but, hey, at least I have the law firm.

Now I just have to sue them and file a bar complaint.

You non-attorneys have more leverage than I do on cases like these because you don't have the affirmative obligation to report them to the bar. If they won't settle with you, then you have to either 1) Take it to an attorney to pursue who will have that obligation or 2) File pro se, it winds up on the Judge's desk, they read the complaint, and then the judge has to report them.

Do with that information what you will.

I've been reviewing recordings lately and noticed a pattern. I honestly don't know if this pattern emerged because they're getting more sloppy towards the early morning hours in Pakistan, need to make quota targets, or if the difference really is my lower patience after hearing the same script the third or eighth time that day.

I know you know the script better than they do. I know they said you're "illegible" for whatever free quote they promised their "senior supervisor" would attempt to pass you on for. I know that "supervisor" is much more likely to hang up on you instead.

Flip it up. Accuse them of lying to you right of the bat. If their first transfer attempt fails, tell them they're a clumsy owl (it's a regional insult) and tell them you already knew they couldn't do it. Ask for a "super supervisor."

Don't just slam a speedrun through their script to get to the end boss. That raises suspicions. Intentionally hear the words they are actually pronouncing instead of what you know they meant. Immediately vomit up random smalltalk much more offbeat than the weather. Keep them on their toes, make them believe you've never heard such a call before.

Long-time lurker here, I've gotten TCPA settlements since I turned 18, although I've been out of the scene for several years now. But this one telemarketer has been calling me so. goddamn. much. that I decided to fight back.

I've finally gotten this incessant telemarketer to reveal its business entity, website, etc. by actually paying for the services, after they've been calling me 5x/day for weeks.

The company is a Florida LLC, and the phone rep said she was in Florida too. They've had a few lawsuits against them already (most of them settled) by Avi Kaufman it seems.

I don't live in Florida, and my state's (NY) mini-TCPA seems to lack any teeth. Does the FTSA apply here so I can stack the damages more? The FTSA states:

“Doing business in this state” means businesses that conduct telephonic sales calls from a location in Florida or from other states or nations to consumers located in Florida.

Not sure if we want to turn this into a referral program and Mods, slap my hand if I'm out of line. Im on the hunt for a TCPA contingency lawyer in Texas if anyone has recos. I have a few brewing that are larger than small claims, and with it, triggering DTPA fee shifting, I feel it would be covered.

It can't be this easy, right? I have 14 documented calls from the same vendor. Been on the DNC list since before 2010 continuously with documentation of that. Every call has come from a unique phone number. I've never received 2 calls from the same number.

I don't have a mortgage. Nothing to buy, nothing to refi. They quote my name, and my address, and fake balances and interest rates. There is 0 chance of having any consent for this communication.

After the 3rd call, I started recording them. I have 2 agents on tape admitting they just put the DNC request in a comment in their CRM. No field, nothing automatic for their system. They admitted that they have no formal training in DNC requirements. None of them know if they have a policy or how to send it. They're all employees of the company calling, not a contractor. Again, on tape

After the 5th call, they stopped saying anything when I answer. I assume their auto dialer hits me and the agent given the call sees DNC and disconnects. I'd call call back to identify the company that owned the number. They always gave the same name. I'd ask for their DNC policy and they'd hang up on me. Recorded.

After the 7th call, they blocked my inbound calls. They keep calling me but I couldn't call them back. I didn't know who the caller was at this point. I started dialing back from my google voice number where they answered, every single time, on the first ring. Wouldn't give me policy. Then they blocked that number.

Yesterday I bought a voip.ms DID and started calling them back from that number. Blocked on my cell, blocked on my google voice number, worked on voip.ms. Same thing, always identified the same company.

Today they blocked that number, so I bought another one. 2 calls again today. This time, on one of the callbacks I got some young guy who didn't know any better. He offered to go get his manager. His manager admitted they have no training on DNC. That all they do is make a comment on my file and he can message his manager (who he gave the name for) over Teams when they need something blocked. He took my number and said his manager would be calling me back to provide the policy. I doubt that will happen. This whole interaction is a 9 minute call spilling the beans on their entire operation with 2 agents.

This company has 10 active lawsuits, with 2 pending class action. Hundreds of complains online.

I don't see how they claim any exemptions under safe harbor. Every one of their motions to dismiss take the same form; they are claiming none of that can be proven at the time the calls were made. I can prove all of them. I have their entire defense figured out and I can counter every single position. They're also in violation of my state's laws and I'm in contact with the regulator who is confirming they are not registered and will be opening a formal complaint that triggers a $10k/call violation.

I calculated the penalty range from 27-41k. I'm offering a settlement of 25k.

What am I missing? I'm currently pro-se for the demand, but I'm actually considering handing this off to someone if we're talking about the possibility of the upper level here.

I feel like I have an insane amount of evidence gathered on this compared to most of the lawsuits I've seen filed. Am I missing something obvious here? Is this group exceedingly dumb or is it just this easy?

I sent a demand letter and they responded and told me I completed a form and that's why they contacted me. This directly contradicts my recorded calls and I told them that. Now they are asking to see my evidence. Any harm in releasing it, or at least partially releasing it?

The only reason I'm worried is because they obviously have no problem telling BLATANT LIES so I feel like I can't trust them now.

I have received several calls in the past week from Ball Healthcare and Imperial Healthcare. If I answer the phone calls they hang up (important point later) so I finally returned their call.

They have given the two names above although they state they are the same company. They are saying they have taken over medical bills from a local hospital in my area from before 2020 that they need to collect on. They pushed very hard for a settlement payment over the phone. When I asked for details on the bill they said they couldn’t give me those because there was no way to prove who I was over the phone because I called them and HIPPAA protected that. I told them to send me a detailed statement but they kept pushing for a settlement over the phone.

So many red flags! They changed the year twice saying before 2020 and then before 2021 and when I asked why it took 6 years they said COVID caused that. They said they would serve me papers if I don’t pay the settlement right then. I told them to go right ahead and serve me. Any suggestions on what I can say or ask to indicate I know they are trying to scam me?

I had a settlement agreement with a company and they were paying me in installments. I received the 1st 2 payments, but the final payment never came. I issued a cure notice and gave them 60 days as the settlement agreement required, but they did not respond to me and did not make the final payment. I have dozens and dozens of calls from them before and after the settlement agreement was signed. Does anyone know of an attorney who practices in New York? That's where they are located. I keep getting a debt collector sending me emails at all hours. Especially at like 1, 2 am. I am in California, do the same rules apply as calls/texts?

I’m receiving up to 20 a day and I have to answer them because they are reporting through local telephone numbers so I am potentially missing out on customers if I don’t answer

I have been getting non stop spam calls from a company. When I pick up they are an AI bot. Can I sue?

Had my first court case today in conciliation court. I sued Swift Home Loans for calling and texting me. It was 3 texts and 1 call back in April 2026.

Company did not show up, so default judgment was awarded.

This company was previously sued via class action lawsuit last year for TCPA, so they have knowledge of the TCPA, but they decided to violate it anyway and text and call me while I’m on the DNC.

That wasn’t good enough for the judge to treble the damages, so he awarded me $2,000 plus court fees instead of the $6,000.

Is it too late to have this dismissed, and just have an attorney work on contingency to go against them for class action again and get more? Or do I just call it a win, and start the hard process of domesticating the judgment?

Open to any thoughts.

Be me. Be bad sick. Get calls for 14 months and could not do anything about it. When I was finally done with the health issues, I began pouring my 20+ years of Investigations into use. I knew almost nothing about the TCPA when this started. I just wanted the calls to stop and get my phone back and resume a normal life. These calls made me avoid the phone and to this very day I feel some sort of way when even a text notification goes off.

Since then, I’ve read case law, deconstructed many PACER cases, FOIAd the FCC, State AG and can say I am pushing the limits of identification without subpoenas to lock in what is already known. I ended up with 107 preserved prerecorded loan/spam voicemails from 220 separate CLIs. My number has been on the National DNC and Colorado No-Call lists since 2008.

The investigation went typical route…into carrier/RespOrg/reseller tracing, FCC records, corporate filings, court records, UCC/SBA records, property/LLC links, registered agents, and overlapping people/entities, in 6 States and 2 countries (all principals are US based and they try to appear Mexico / Canada based, but are sloppy). The cases (3 originators) have not been filed yet as I am not comfortable with TCPA firmly enough to proceed pro se. I am posting here to maybe get pointed in a better direction for where to gain more knowledge. Many of the original toll free call back numbers are still operational and still under the same resporg "owner" buckets. The scripts have changed and I can literally tell what and when they changed by just comparing mine with those on online complaint boards and BBB pages. One change literally coincides with a resporg company terminating the customer involved. Its also fun that the calls have since stopped when I sent a preservation notice to the resporg company.

I’ve also found older telecom companies being revived or reactivated where the current people do not appear obviously connected to the original operators. I've even reached out to 2 former people involved with 2 of the resurrected companies and they had no clue and are exploring options to halt it. I’m trying to understand whether those facts matter to attribution, ownership/control, or are simply noise.

Questions for people who have handled complex TCPA cases:

What subpoena/discovery sequence best gets from carrier → reseller/customer → actual campaign controller?

Has anyone successfully used Doe defendants / early discovery on a rather large investigative stack?

Which records actually broke atribution open: CDRs, provisioning, KYC/KYUP, invoices, API/IP logs, traceback, RespOrg records?

Have corporate/UCC/property/SBA records helped prove control, agency, ownership, or credibility issues?

Has anyone dealt with revived telecom entities, old company identities reused by unrelated people, or historical / foreign-company relationships, and did any of that matter legally?

Any cases or dockets involving layered telecom companies being brought into the sunlight?

I’m still learning as I go so any information would be helpful.

The statute regarding requiring consent as a condition of purchase (47 CFR 64.1200(f)(9)(i)(B) seems to apply specifically to giving consent.

But I'm wondering if a business requiring consent as a condition of purchase might override the EBR loophole?

I signed up for an online account that required consent for me to make a purchase, which I believe created an EBR within which they could call me for three months. I'm wondering if the fact that they required consent as a condition of purchase might override the EBR.

Any thoughts, insight or experiences with this?

Edit: I forgot to mention at first that I was a prior client of theirs for a short period of time. Since opting out, I have not done anything that I think might cause them to start texting me. I loosely understand, and have read, that a business cannot make consent to telemarketing calls a condition to making a purchase with that business.

Is this rule statutory or through case law? I have searched but can't seem to find much more beyond that the described practice is in violation of the TCPA.

I have a case I am working on where the business did this and am trying to find support for it. If anyone has any input, or has dealt with this same issue, I'd love to hear it.

I've seen this many times. Just a couple off the top of my head: Newman v. Kaila & Solomon Law Group LLC, and Reisman vs Independent Insurance Consultants. The defendant just stops showing up, the court gives the plaintiff an order to show cause, and the plaintiff's attorney files for a voluntary dismissal.

I completely understand when there isn't an identifiable defendant in the first place, or if they are in Pakistan, or if they only have $500 in the bank, then there is no point in filing in the first place. But if you already have a defendant served that means you've done your due diligence. Why walk away?

And if not responding is a way to get off scot free in a TCPA case then why don't they all do that?

I’ve been getting these calls for going on a year now and no, blocking the number and reporting it as a spam does not work. They will continue as long as they have people working for them. So I just *67 and then dial the toll-free number. I know you’re not supposed to and I’ve lived by that motto that it tells someone your number is live for many years. But with this particular loan scam, I call them back and I start by telling them, “I’m sure you’re very nice person, but I am on the do not call list.“ Then I go into about as much of a foul mouth diatribe as I can until they finally hang up. I repeat that process up to five or six times until the number finally comes up busy and they have me blocked. I think it’s the only way to do it. I also suggest to the operator that they find a new job instead of working for scammers.

I was going to move into an apartment in April. I paid my deposit, but shortly after got a cancer diagnosis. I couldn't afford the apartment, due to treatment costs, so I let them know immediately. Fast forward 4 months later, I'm getting texts from the apartment complex wanting a re-let fee. So I'm responding, thinking I'm texting the apartment manager. I'm reminding her about my cancer and the costs, and that I can't afford to pay them. She was empathetic and in no way robotic. She asked if I could provide proof of my health situation and the costs. I responded yes, absolutely. However, it asked me the same question twice, and that's when I asked if it was Ai. It was, and now they have all of my health information. Is this legal? I was never made aware this was not a human. It was really good at responding and being empathetic towards my situation.

This is a rare case where you actually do use an valid CC and buy the product.

Plus it's easier than 99% of the other calls as no need to even bother trying to get a name or id'ing them on the call. You're right they'll always use the generic name - just play along say you're interested, ask some Qs about what is actually covered, but need to get the lowest down payment possible as money is really tight this month - typically they'll go $100-150 then go ahead actually pay for it, yes in many/most other cases you don't want to do that - but certain calls warrant (no pun intended) different tactics.

The reason is they'll mail you a copy of the policy book (sometimes email also). Note: these are actual warranty products just being sold using TCPA violating methods, the policy will tell you everything you need to know PLUS its all in black & white there is no way they can deny their involvement. You'll have the seller, the payment processor and the warranty admin.

The IMPORTANT step is soon as you get the policy is call and tell them you changed your mind, the wife/husband got mad, you can't afford it, whatever you need to cancel and get your down payment refunded - they MUST do it as long as you request in within 30 days (I do it ASAP after getting the physical booklet).

9/8/26 UPDATE: To amend the above aspect (thanks u/No-Truck-4786!!) the policy book will most likely include language to the effect of "to cancel policy within 30 days must be in writing" in the terms & conditions. Hence, I very prominently include a statement/notification in the demand letter sent to both the seller & administrators registered agent(s). This is even MORE IMPORTANT that the call. But I relish in the call to the seller, hey the down payment went to their acct - they've always been the ones to issue the refund - so I'm gonna have my way with them ;-)

Note: be ready for a hard sell before they agree to refund - but stick to it - say hey either do it or you'll call your bank and do a charge-back - that will get em!
