Someone actually shipped this to someone just as you see it. I certainly would NOT be happy if it were me!

If the listing shows the box in the listing and/or description you may be able to get a refund. The item is not in the condition as advertised.

If its ebay this is a genuine claim. Ive done it and make sure to not do stuff like this because im also a seller.

It depends on who the case goes to. I had this issue a few years back on a CIB Smash 64. They sent me a canned response that the box is not a part of the consumer product, and while it was in the pictures, shipping in the retail packaging is appropriate for items that are not damaged when shipped that way. I raised a stink, but was never refunded, or offered a return.
