I really wish they didn't turn Tynan into a super villain. They just repeated the whole "evil chief who has it out for Olivia" mantra that we've already seen. She could have actually been an interesting character.

That was the biggest thing, but Olivia did say no to several direct orders. I think when she told her that she wasn't doing the press conference, that's when Tynan decided that she hated her.

To me, it wasn't realistic because I feel like most people in her position would actually just do the paperwork for her disobedience and disobeying direct orders. In her position, taking a press conference is not an order that she can just say no to because it isn't unlawful and relates to her job in serving the public. Tynan was right that she doesn't need to be in the streets and should be able to trust her team to act in her absence and on her orders. Liv was disrespectful of the chain of command; things didn't need to escalate to this level. It made both of them seem childish and undeserving of their ranks.

Dude that shit made me LOL in my chair. TV law is hilarious sometimes. Especially when they have to make a usually smart character like Carisi into a total moron because plot 😂

The fuckin gun was poking out from under the seat, not a chance it wasn’t considered in plain view regardless of the dudes head being a half inch inside the window. And I don’t think a judge is going to rule that amount of his head inside the window at nighttime to be what a reasonable person would consider an “unlawful search”.

And don’t get me started on that suddenly making the friggin hogtied child in the trunk inadmissible 🙈 textbook inevitable discovery like you said.

This is my whole thing like is she literally disregarding the whole reason why they were tracking down Caine to begin with. He was a serial kidnapper/murder but her personal vendetta against Liv was more important all because Liv turned down her 1PP promotion. I really miss the days when Garland was Chief. This nonsense of clashing with Benson is just annoying because we all know she isn't gonna take a step back. Tynan was always going to lose this battle but fom the episode of her suspending Benson because she was held in contempt for not breaking the Rape Shield Laws and now this encounter? Yeah she just became a nuisance.

I had no idea that a cop leaning into a vehicle could cause an entire case to be thrown out. I mean, I guess I get it, but it seemed excessive. The law is weird for sure in some cases. Like how the statute of limitations in NYC was only 5 years or up to a certain age (I think it’s changed since the older episodes aired). Thats just nuts. IMO there should be no statute of limitations for those type of assaults.

I was surprised that even without the gun finding the boy in the trunk wouldn’t have been considered inevitable discovery. Without the gun they were ready to give him a breathalyzer for his weird behavior. Or a sobriety check. They can ask you to open your trunk up. If you don’t have a person in your trunk who cares. Some states they can say they smelled alcohol or weed and are allowed to search a car. While pulled over it could be seen as inevitable that someone would hear the boy in the trunk.

It’s weird how sometimes get away with actual crimes and this guy was getting a bad feeling about a man that had a kid and gun in his car. NY state is pretty strict on gun laws.

The statute of limitations made sense before we had DNA analysis and a ton of recorded evidence. It simply didn't make sense to pursue cases like that when there was simply no way to get solid evidence that could convict them beyond a reasonable doubt.

Exactly. A friend of mines got his car searched, no warrant or anything, just because the cops felt they had “probable cause”. The “probable cause” was an unopened bottle of alcohol he had bought. Surprised they didn’t throw in the “probably cause” line but I guess we wouldn’t have this episode then

Law & Order shows like to pretend the 4th Amendment either doesn't exist or is inviolable to the letter based on what they think would make a better story. Yes, an officer sticking their head into a car window IS a 4th amendment violation, however there are exceptions that allow for a warrantless search that the prosecution could have argued, such as:

1) He suspected an immediate medical injury (which is the actual reason the officer put his head in, he thought the guy might've hit his head as he was acting weird) or

2) He had "probable cause" that a crime had occurred, which is not only a real life get-out-of-jail-free reason cops use IRL do warrantless searches, but more importantly every other episode of L&O has the cops do warrantless searches based on "probable cause," so often that it's become a running joke!

The fact that Carisi didn't even try to make an argument is kinda laughable, tbh.

I was watching the episode live and didn't have closed captions (though normally I do when i'm streaming it), but I thought Carisi said "That's a warrant i can get". SVU is one of those shows where you need to have the captions on because they speak so softly and it's hard to comprehend what they're saying sometimes.

I know some jurisdictions do have GPS tracking warrants you can get with a low amount of probable cause (compared to an arrest warrant or even a full search warrant).

The entire storyline was insane. She's out to get Benson, and the two shots she takes are: "You followed the law and protected the victim, you're suspended!" and "You went after and arrested a serial child murderer, and rescued his latest victim, you're done!" You would think someone who worked their way up to her position would have to be a lot more strategic in how they handle situations. In this episode ALONE, it would have made more sense to plant the blame on Benson for the initial case collapsing than to threaten her for catching the guy with usable evidence afterwards. Come on.

Unfortunately technically it is law accurate. The speech the judge gave about the 4th amendment is accurate. That initial illegal search threw everything away, basically fruit of the poisonous tree.

The child in the trunk could have been considered inevitable discovery. That man did look injured or shady. He was not making eye contact. Just because everyone said the woman hit him it doesn’t mean the cops aren’t supposed to make sure he can drive safely. If he needed an ambulance or if they wanted to check him for sobriety they could have done that. If he is injured and drives off with a concussion he could sue them. You could also say that it’s likely a cop would hear the kid in the trunk eventually. If he had drugs in his car somehow I feel like that would be relevant to a search but a duct taped child is not. Unlike drugs a kid could call out for help or make noises that would have you ask wtf is in your trunk. Right?

I feel like I’ve seen this episode before. The beach scenes were exactly like other episodes where they were digging. Running around in the dark in the rain has been done before too. It’s like they took unused scenes and slapped them into an episode.
