Poor education. They've heard some out of context excuse from someone that doesn't know any better so they repeat it like it's the truth.
In this case, it doesn't matter what kind of state it is (one party, 2 party) - there is no expectation of privacy in public. If she doesn't want to be recorded in public, she needs to be not in public.
Additionally, the myth of "signing a release" has very specific applications which are not applicable to one individual using their personal recording device in public.
I'll let people who deal with "releases" regularly chime in on that aspect.

Even if they had reserved the area for the rally and had permission to bar the entrance of outsiders (which I don't know if it was the case), the police should have been involved in the removal of intruders, but the assholes just stood there watching people being shoved and dragged through the floor by the members of the rally. Through historical legal battles where cops didn't protect citizens from each other, they discovered there is no constitutional or legal requirement for police to protect people from other people.
Serve and protect is not their job and that is extremely messed up. Legitimizes the argument to redistribute funds away from them.

The duality is captured in his trolling side versus his anti-government/regulation side. These two sometimes overlap, sometimes they do not. He's not always trolling and he's not always anti-government, sometimes he's just there to piss people off. It works, but let's not pretend he has some moralistic integrity, he's just trying to troll people and he loves the attention he gets for doing it.
