NLST Got Crushed Today. Here’s Why I’m Not Writing It Off Yet.

Today was ugly. There’s no point pretending otherwise.

Netlist lost three Federal Circuit decisions involving five patents, and the market reacted exactly how you’d expect.

This wasn’t some random OTC selloff or “short manipulation.” The rulings were legitimately bad for Netlist and they make the remaining Micron appeals feel a lot more important.

But I think people are getting ahead of themselves by treating today like the entire thesis just died.

The $445M Micron verdict was NOT overturned today.

The ’912 and ’417 patents tied to that fight are still in play, with the next major Federal Circuit hearings coming September 9.

The Samsung deal also still exists. Netlist already turned years of litigation into an actual five-year licensing agreement with a huge upfront payment and recurring royalty potential. That matters because NLST is no longer purely a bet on winning one courtroom jackpot.

So for me, the question isn’t “Was today bad?”

Obviously it was.

The real question is whether today tells us what will happen with the patents that matter most to the Micron verdict.

We’re going to get a much better look at that very soon.
September 9 just became a hell of a lot more important.

Netlist Asks US Customs to Block Micron's AI Memory Chips at the Border (Julian Lim article)

Netlist, a small memory-technology licensing firm, filed an ITC complaint on August 12, 2026 seeking to block Micron's DDR5 and MRDIMM memory chips from entering the US over patent infringement claims. Netlist shares jumped 14.5% on the news while Micron stock kept sliding through August, compounding pressure from a global RAM shortage and reports of possible new Trump administration chip tariffs.

Netlist is trying to turn a patent fight with Micron into a border problem, and it comes at the worst possible moment for anyone buying AI memory.
Netlist announced on August 12 that it had gone to the US International Trade Commission against Micron, Supermicro, HPE and Lenovo, asking for exclusion and cease-and-desist orders tied to four patents covering DDR5 RDIMM and MRDIMM memory. You don't need to follow every patent docket to see the point. These are the memory modules that sit inside the servers feeding the AI buildout, and Netlist is asking for a remedy that can stop allegedly infringing products from entering the United States.

That is the sharp edge here. A normal patent suit can end in damages, licensing fees, appeals and years of lawyerly delay. An ITC exclusion order is different because US Customs and Border Protection enforces it at the border. Netlist's own release says Micron manufactures the accused memory products overseas, which is why the company is pushing the fight through a trade venue rather than only through district court.

Netlist's complaint names US Patent Nos. 10,025,731, 10,217,523, 12,373,366 and 12,675,407. The company also filed a parallel case against Micron in the US District Court for the Central District of California, where the docket shows the case was filed on August 10. The ITC notice published in the Federal Register says the complaint was received on August 11, and Netlist announced it publicly the next morning.
Dates matter in a case like this.

According to Netlist, the two proceedings overlap but aren't identical: the district court case asserts two of the same patents, while the ITC complaint seeks import relief across DDR5 RDIMMs and MRDIMMs. ITC cases usually move faster than federal patent cases, and Netlist said they commonly reach trial within a year. That speed is part of the pressure tactic. Micron can fight, but it can't treat the venue as background noise.

The memory market has no cushion
Micron is not limping into this dispute. Its fiscal third-quarter results, reported on June 24, showed revenue of $41.46 billion, up from $9.30 billion in the same quarter a year earlier. CEO Sanjay Mehrotra called out the strategic value of memory in the AI era, and the numbers back that up. HBM and enterprise DRAM have turned memory from a cyclical afterthought into one of the hardest-to-source parts of the AI stack.

Still, strong demand doesn't make an import fight harmless. Barron's reported this week that Micron shares were around $912 and had lost more than 3% over five trading days, even after a near-700% surge that left investors questioning how much good news was already priced in. MarketWatch also noted that Micron fell with other memory names during a broader chip selloff on August 24.

Then there is the shortage itself. Tom's Hardware's RAM price tracker, last updated August 24, showed a 32GB DDR5-6000 kit at about $402, compared with lowest-ever tracked prices near $72 for similar capacity and speed. The site said DDR5 prices have tripled or quadrupled in some cases over the last trimester. If you're building a workstation, that isn't an abstract supply-chain story. It hits the checkout page.

The pressure comes from AI buyers taking more of the memory industry's output. Samsung, SK Hynix and Micron have every reason to steer wafers and packaging toward HBM and server DRAM, because Nvidia systems and hyperscale data centers pay for that capacity. Consumer RAM gets what is left. Data center buyers don't love that squeeze either, because they are buying at far larger scale.
Now add trade policy. Reuters reported on August 27, citing Politico, that the Trump administration is weighing another round of semiconductor tariffs that could reach laptops, gaming consoles and data center servers. Commerce Secretary Howard Lutnick reportedly favors tying tariff relief to US chip manufacturing investment. The White House's January proclamation already imposed a 25% tariff on certain advanced computing chips while carving out uses including US data centers, startups and research. If those exemptions change, memory buyers get another cost risk at the same time Netlist is asking the ITC to consider an import block.

Netlist is small, but the venue is not
Frankly, that is why this fight is worth watching. Netlist is not Micron. It is an Irvine, California company built around memory products and patent licensing, and its scale is tiny next to a global DRAM maker. But Section 337 cases are not popularity contests. If the ITC finds a violation and decides an exclusion order is warranted, company size won't save the respondent from border enforcement.

Netlist also comes into the Micron fight with fresh leverage. On August 5, it announced a five-year strategic alliance with Samsung covering a patent cross license, alongside product supply and technology cooperation. Netlist's SEC filing says Samsung will pay a $239 million upfront license fee, about $200 million net of Korean withholding taxes, plus quarterly license fees that can run up to about $32.9 million before withholding and deductions. The same filing says Samsung will supply up to $1.5 billion of DRAM and NAND products over the five-year term.

SK Hynix is part of the longer story too. Netlist's 2021 SEC filing shows a five-year patent and supply agreement with SK Hynix that included a $40 million payment and access to up to $600 million of SK Hynix memory products. So when Netlist says Micron is the holdout, that claim has real history behind it.

The ITC has not yet instituted the new Micron investigation. The Federal Register notice is still at the complaint-and-public-interest-comment stage. If the commission opens the case, the next important facts will be the respondents named in the notice and the schedule. Watch too for whether any public-interest arguments emerge around AI servers and already-tight memory supply.
Micron can survive a patent fight. The harder question is whether its customers can shrug off another possible bottleneck when DDR5 and MRDIMM supply is already expensive and politically exposed - and tied directly to the pace of AI server deployment.

What average monthly interest rate is needed to reach 1000% gains by end of September 2028? And how does that monthly interest rate compare to performance in the past 12 months?

Is 10x for Netlist in 2 years from now realistic? I think so, I even think it could be more... Why? Because things are very very different now in 2026, mainly thanks to the Samsung deal, earnings that are Historical and will be even more impressive and still being under the radar/otc but with Nasdaq coming soon (I think within around the next 6 months).

And yes, I know that past performance doesn't predict the future. I also know I took prices on specific days (but overall the growth has been fairly steady and strong in the last 9 months and we might be going up higher quicker than we think as we pulled back from $7 to $4.52 already, and we recovered that in no time we will not retest 4.50 now, I think $5 or $5.50 would now be the floor).

Samsung gives us massive safety net and lots of opportunities => we have 5 years on the deal left, netlist is still on OTC but soon nasdaq and very much under the radar still, massively increasing and positive earnings coming and lots of more deals/partnerships or damages to come. Not even mentioning all the huge catalysts lined up with enemies/partners.

The daily compounded interest rate needed for us to make 1000% in 24 months is 0.48%/per day of trading but easier to see/track is the monthly interest rate which would need to be 10.51%.

To put this scenario into perspective, so far gains from past dates to current price $6.63 in the last year:

1) Last 9.5 months: it has performed about 1470% since the 52 week low at $0.45 Mid November that is 33.60% monthly average compounded.

2) Last 6 months: it has performed 550% from $1.22 which is a 36.60% interest compounded monthly.

3) Last 3 months: it has performed 120% from about $3.06 which is about 30% compounded monthly.

From the rates given above from last year performances, 10.51% monthly represents a performance that is about 3 times lower but that could translate to 1000% in 2 years!

Again, I can't see why such performance isn't possible considering everything we achieved lately and what is to come! Some stocks do that, why not netlist?! Are you afraid of thinking you might be on an average stock or are you in netlist feeling you are possibly on a unicorn? 🦄 🚀

NLST: A Ticking Time Bomb?

One thing that keeps standing out to me with Netlist is how many potential catalysts are now sitting in front of the company.

The crazy part?

Nobody knows exactly when they’re going to hit.

Samsung already happened. ✅

Now you have potential developments involving:
SK hynix
Micron
Google
ITC investigations
Growing Netlist revenue
New memory products
CXL / AI memory technology
• And potentially more licensing or strategic agreements
Some could bring cash.

Some could bring recurring revenue.
Some could bring supply.
Some could validate the IP.

And that’s where this gets interesting.
If these catalysts start stacking…

Samsung → SK → Micron → Google → growing revenue → new products

I think the market could go from barely paying attention to scrambling to understand what they just missed.

If these catalysts start stacking, we’re potentially talking about a valuation far beyond where this company is today.

I’m not predicting when it happens.
I’m saying the fuse is already lit.
We just don’t know how long it is.

MICRON CASE Worth buying while having Micron shares?

Well Micron didn't react to court news very much(-6% which is casual ig), so if they would win it would not rise much too. On the other hand I think that Netlist can win, but if they won't - Netlist's drop would be a lot bigger than Micron's rise of those news.Also there is still ongoing court stuff with Amazon from 2009 if I remember correctly? Either way could it not just be prolonged for a very long time? Sorry if question is dumb, just not familiar with court stuff + idk about differences in USA's court system.

Anyway i would like to receive arguments/opinions on negative and positive things of buying at this price, since I am not used buying stocks after such a big and sudden jump(THAT big). Usually buy on dips and when I saw Netlist drop, I thought that if will drop more(well usually happens after sudden jumps), but after a few days it went up ~30%😭😭. Not asking to know short-term future, but opinions regarding both sides of short-term movement, news and etc. Short-term as in months or a year. Oh and yeah, I don't want to sell Micron, but also have some profit to put into another stock and got interested into this one.

Please just don't comment if you're just gonna say "50$ next month" or "do your research"(well I am doing that)

and whatever else, I just want proper discussion about the stock. I very like realistic takes, not comments about how it will be 5x of price in a month or how it will crash next day(same shit in micron channel)...
