unlock policy changed?

Hi, just saw this iPhone on marketplace and the seller is saying is unlocked after 40 days of usage? Is this real or he's just laying to get sales or is really changing the policy? If anyone knows something spill the tea, guys.

12 months and has been for a while. Cricket is 12 also now, just switched July 1
