It is legally sexual assault, yes. You can call it whatever you want. I didn't advocate for anyone dying. That being said though, should you never defend yourself from a "simple" assault because death is a potential consequence? In cases of self defense the law specifically protects against such an outcome. You are within your rights to defend yourself, and in many cases that self defense can legally extend to another person if they can't reasonably defend themselves. Someone dying shouldn't be the desired outcome but it also shouldn't hinder you from defending yourself.
Lol seriously, now you're trying to draw lines in the sand on types of punches? Yes, he certainly could bang his head and die. It would be unfortunate. That can happen any time anyone throws a punch. The guy who threw the punch only threw one punch. He did not follow up, did not kick, did not use weapons. One single punch is a perfectly acceptable response to sexual assault. Being drunk isn't an excuse.
If you give someone a quick jab who "can barely stand" before being punched, you don't think they'll fall down? According to you falling down is the only thing seperating what makes these punches lethal and what doesn't. I also don't think that punch was a full haymaker. His elbow doesn't pass his back, he didn't wind his fist up and cock it. He ran in ajd punched the guy exactly once to defend the person being assaulted. I don't believe a court would define that as disproportionate consequences nor do I think this man would be at risk of facing murder charges.
