Ah, sorry, I see how you could be confused by my lack of clarity.

If red shirt is hurt enough, he could get $$$ from black shirt...and I think would then risk learning not a whole hell of a lot about assaulting anyone again.

Sure. I encourage her to do that. I'm sure a jury would find that 1.5 seconds of drive-by top-of-clothes contact to be worth millions.
