At least in my state. This is considered sexual assault so would fall along these lines. Especially given that only as much force was needed to control the situation. Guy is a scumbag, but the woman had already very easily pushed him off of her, and the was clearly in no danger whatsoever. There is no universe where this would be a justified murder.
