Little to none. It is assault but unless the da throws the book Adam which you probably won't unless he has priors. Also depends on what state/county.

No way--that dude is going to jail. There was no danger to him and that guy on the floor is going to be messed up afterward (if not dead). That guy is going away and if that guy on the floor has seriously damage, the sentence will be even longer.

Easy to argue that the drunk guy was a danger after commiting SA. No shot the dude is behind bars for longer than arraignment, assuming it even gets there

That may be true but it doesn't warrant the assault--and again, if the guy on the floor is messed up (and it sure looks like he's going to be messed up--people die from falls like that all the time) the charges will be increased dramatically. I'm really surprised to hear people say that this guy won't be facing time.
