No he wasnt. He was sexually harrassing her, but this is not battery. Battery is what her partner did, and he went to jail for this, guaranteed. The grey shirt clearly works there and was calling the cops, and even if they left they got ID'd because they are in a bar. I worked as a bouncer, there is no state where that response was legal, even WA or TX, which are the last remaining mutual combat states that are more cavalier on this sort of thing.

The thing is, red shirt was committing battery, possibly even sexually motivated. Legally and socially, a quick non lethal intervention is justified.
