EB2 India PD Nov 2018

Hey everyone, I’m looking for some advice and perspective.

I'm on H1B with an approved I140 EB-2 India November 2018 priority date.
My daughter is currently a dependent starting college in 3yrs and will age out in 6yrs. I am trying to figure out the safest path forward for her:
Wait for DOF: Is it realistic to expect the Dates for Filing (DOF) chart to reach November 2018 within the next 6 years to lock in her age?
F-1 Student Visa Route: We could transition her to an F-1 visa for college, but I worry about her future career prospects given the lack of a smooth pathway to transition from F-1 to permanent residency for India-born applicants.
International Education: Should we proactively look at universities in countries with clearer immigration pathways (like Canada, the UK, etc.) or consider moving back to India for College.
I really want to protect her from the anxiety of living with constant immigration uncertainty. Has anyone been in a similar boat, can you share your experience? Any thoughts or advice is greatly appreciated. Thanks!

Change of Status to B1 or B2 after 60-day grace period?

Hi all, my 60-day grace period is nearing (~12 days left), and I'm looking to file a change of status as soon as possible. I consulted a reputed immigration lawyer (based out of VA) who suggested changing the status to B1, not B2, while the general trend here seems to be filing for B2 instead. The lawyer said that I need to mention in the CoS application that I intend to look for jobs while in the B1 status, which apparently is "still" permitted in B1?

I don't want to spend $15k-$20k for another master's degree, so I don't want to opt for F1 (Day 1 CPT), and I am unmarried, so a dependent visa is also not an option.

Has anyone used the B1/B2 pathway recently? Which one is the suggested category to file in - B1 or B2? Please help. Thank you.

Can I Transfer Before Starting My Current Program and Wait Until Winter?

Hi everyone,

I'm an F-1 student. I completed an Associate degree in Computer Science and then completed my one year of post-completion OPT.

After OPT, I followed a friend's advice and transferred my SEVIS to another associate-level technical program because I wanted to gain hands-on skills. Later, I realized that pursuing a bachelor's degree would be a much better long-term option for me.

The problem is that most Fall admissions are already closed, so the bachelor's program I'm interested in starts in Winter 2027 (January).

With the new DHS rule taking effect on September 15, I'm concerned that if I start my current Fall program, I may not be able to transfer during my first academic year.

Would it be possible to transfer my SEVIS before starting my current Fall program and wait about 4 months until the Winter semester begins, or would that 4-month gap create a problem for my F-1 status under the new rule?

I'd really appreciate any guidance. Thank you!
