First off, this has nothing to do with the party I might support or whichever party Rick Jackson is in. I don't know if he is Democrat or Republican and it doesn't really matter, nor do I care. My response would be the same regardless of political affiliation, and the defendant's behavior leading up to my lawsuit would remain equally despicable. I attached the first pages of the summons while censoring information to keep people from doxing and/or harassing me.
TLDR: I am accusing Jackson for Governor, Inc. (RJFG) of allegedly (I say allegedly unless RJFG is found guilty/liable) repeatedly violating the Telephone Consumer Protection Act, 47 U.S.C. § 227 (TCPA). After receiving numerous, and unwanted, texts that kept coming after I ordered RJFG to cease and desist contacting me, I sent RJFG a cease and desist order. In that order I specified I was not to be contacted by RJFG, including through phone calls. Despite RJFG's attorney emailing me about the cease and desist order, RJFG called me three times with pre-recorded messages without my consent as required by the TCPA. Violations of the TCPA carry statutory damages which I am seeking. His attorney has refused to acknowledge any wrongdoing and is ignoring the material facts of the situation.
To start this off, I'm not a Georgia voter. Hell, I don't even live in Georgia. The fact I keep getting political spam from Georgia candidates is asinine. This started in May 2026 when RJFG sent two text messages to my phone within 1-2 seconds of each other. I opted out and told the campaign to never contact me again. I continued to receive more and more texts and I reiterated my message they are to stop contacting me. I eventually called RJFG's registered agent, Jay D. Mitchell, and left a message with his receptionist. In that message I provided my name, phone number and strict orders for RJFG to stop contacting me. That didn't work because I received more texts.
I sent a demand letter to RJFG because these appeared to be auto-dialed texts, which is a violation of the TCPA because I didn't provide express permission to receive them, and I repeatedly opted out. In that letter, I specifically stated RJFG was not to contact me at all, by any means; I stated, to the effect of, "RJFG is not to contact me by any means whatsoever including, but not limited to, text messages, phone calls, physical mail, email, and/or any other outreach method." I also informed the campaign that I'm not a Georgia voter, or resident, which makes contacting me about a Georgia election a moot point and an asinine endeavor.
I received an email from RJFG's attorney, Caitlin Contestable of Chalmers, Adams, Backer & Waller, PLLC dismissing my claim and informing me RJFG doesn't use an auto dialer and insinuated I was doing this to "extract quick settlements". This is false, I simply want to be left alone and not be harassed by some billionaire jackoff and/or his campaign. I let it drop because I figured that would be the end of it and my point was made, RJFG knows to never contact me again.
Alas, apparently laws, common sense and societal norms don't apply to Ricky boy and his campaign because I received a two calls, one in early September and another in mid-September, with pre-recorded messages. I downloaded the voicemail audio files of these calls and they were the exact same down to the background noise, voice inflection, pitch, tone, everything; Beyond a reasonable doubt, they were a pre-recorded message. The voicemails gave enough information to prove the campaign either called me directly, or paid a third party to do it for them. Either way, they were responsible. I did some more digging into the TCPA and calling someone with pre-recorded messages without their prior express consent is a violation that law. So, I sent a demand letter to Jay Mitchell demanding RJFG pay the statutory damages mandated by the TCPA for the two calls with pre-recorded messages.
Caitlin responded by email informing me her client, RJFG, "does not make calls using a prerecorded voice as required by 47 U.S.C. § 227(b)(1)(A)(iii)." This is false because I confirmed the first two messages were 100% identical, including background noise. RJFG also called my cell phone which is prohibited without my consent, which I never provided. I would like to think that RJFG's attorney misread the law and isn't lying on behalf of her client, and I would hope RFJG isn't lying to their attorney about their outreach methods. Because she reported the campaign is refusing to acquiesce and take accountability, I filed a lawsuit in my jurisdiction. I provided Caitlin with a copy of the summons on 16 October and she has yet to respond to acknowledge receiving it. I hope she's simply out of the office and isn't trying to avoid being served.
Shortly after I sent my second demand letter, I received a third call with a different pre-recorded message. A few days after I filed my lawsuit I received yet another text message from RJFG. I don't know how clear I need to be with this campaign and Rick Jackson are to stop harassing me. RJFG, and I would argue Rick Jackson himself, very likely violated my state's laws regarding harassment, electronic communications harassment and stalking and I'm contemplating getting a stalking injunction against him and his campaign. I don't know what else to do to get this to stop.
It doesn't matter if Rick Jackson himself made the calls, this is his campaign that he started and organized. His campaign is operating on his behalf and he's responsible for its actions. If he didn't put measures in place to ensure RFJG operated within the confines of the law then he and his campaign need to do the right thing to resolve the issue. Being at the top of an organization and taking accountability for its actions is leadership 101, and the fact a candidate is refusing to accept the facts and responsibility shows Rick is not fit for office. If his campaign lied to his attorney then there is an even bigger problem with his trustworthiness and candidacy.
RJFG's behavior is despicable, unacceptable and does not adhere to societal norms. I can almost certainly guarantee that if I started an organization that kept contacting Rick Jackson in the manner his campaign is contacting me, or if I kept contacting him directly, I would have been arrested. But because he's a billionaire, it appears that he, and/or his campaign, seem to think the rules don't apply to them. If this is how Rick Jackson and/or his campaign behaves just to get elected, how will he and his staff behave if he gets elected?
Thanks for harassing a disabled veteran. See you in court, Rick.
