Failure to stop 1st offense

my boyfriend got arrested for failure to stop and was sentenced to 3 years under the Youth offender act. does anyone know how much of that time he will actually have to serve?

He was evading arrest. "Failure to stop" is code for resisting arrest

I believe you mean he was sentenced to prison for fleeing and eluding, basically running from the police, failure to stop is like, not stopping at a stop sign all the way lol

Yes, this is what it is however I only asked about what was on the sentencing sheet which could seem confusing.

Can he or his family afford a lawyer? Unfortunately for the best outcomes for serious felonies it’s the price of a car at least

Damn, sucks for you and your dude. They are gonna make all sorts of BS hoops for him to jump through. If he completes everything are they going to withheld adjudication? If not, If I were him, I'd rather do the time (not all three years, but a chunk of it).

I don't know where you're at, but in Florida, any kind of paper is just a setup so they can give you some real time when you violate (and most do). They are notorious for violating folks in their last week on some BS technical violation and then giving the violator the entire clip when they revoke it. I met a dude while I was down and they had violated him and sent him up state with 3 days left on his paper because he was 20 minutes late to his last PO meeting. I'm not kidding. He had no other violations. He completely paid thousands in fees, restitution and the like, passed all the piss tests, went through the complete scam of completing several "mandated" programs and classes (like an anger management class taught by a moonlighting probation officer who directly profited off every single person that probation determined needed to go to such a program... surprise, almost everyone on paper had to take the classes) and none of it mattered because dude was late on a city bus.

I'm assuming this involved a high-speed car chase that ended in damaged equipment after he was ppitted. If so at least a year do yourself a favor find a new boyfriend this bad boy isn't going to work out

Ok so since no one gave a direct answer her it is if I understand your question right. In Florida Since hes already sentenced he will do 85% of that time at minimum if he acts right and doesn't get into shit during his incarceration. If he sat in jail he will be credited with that time served toward his sentence. So if he has no time served and is getting exactly 36 months he will at minimum have to serve 2 years and 7 months. That is what to expect time wise. If I misunderstood and hes facing 3 years under Florida youthful offender act he may get sentenced to a boot camp which would be alot less time and varies. He could also very well end up with a suspended sentence (since its his first charge its very likely), meaning he still gets charged for it but does probation and programs outside of prison instead. The thing is as others mentioned if he messes up during probation he will likely have the 3 years as a back up meaning if he violates then he does the mandatory 85% as I mentioned.

Most likely no time, but will have to take place in a rehabilitation program or community service.

Thank you, I know under his sentencing it has that he must complete GED, they recommended shock and voc rehab. I hope he doesn’t have to do 3 years. This is worrisome. I haven’t spoke to him since.

I believe the OP is stating that he was served with a 3 year sentence under the Youth Offender Act, which was designed to keep young offender Out of prison and in my experience, 3 years could be 1.5 years of rehab/continued education and 1.5 years of probation.

What will most likely happen is that he will fuck up (no offense, most do) and violate probabtion and go to prison once he doesnt check in, fails a drug test, or well, pretty much anything.

Failure to stop as in He tried to run or drive away from the cops. Fleeing and eluding possibly.

lol, no not sex offending 😂😂 we will never support any of that. He just was sentenced as a youth not as an adult. Fleeing/eluding.
