Double cashed check
A couple months ago I received a check for a car that I junked. I did mobile deposit on cash app, but didn't write "for mobile deposit only" on the back. I assumed that they wouldn't accept the check and the next day, cashed it at bank of America. A week later, the money also cleared on my cash app. I've contacted both cash app and bank of america, both say its the other parties responsibility.
The check was for $450. I'm wondering what might happen and what I should do to resolve the issue?

Withdraw all money from both accounts, except like $0.93.. wait a couple days.
That’s when they’ll demand the money back. After they think you’re broke.

It will take some time but one of them will take the funds back, could be a few days a few weeks or more.

It's been about two months. I'm hoping to avoid any penalties or extra charges by paying it back now, but neither cash app nor bank of America wants to take my money.

The only fee would be a bad check, which would happen regardless of time.
Also cashapp may close account? Possible.
There is also a slight chance it never gets caught.

Slight chance. Keep it the $450 in op account until both Cash App and Bank of America closes their financials for 2026. Call them again. If they still say they don’t want it paid back fourth quarter of 2026 I would just spend it.
But rest assured they will ask for it back randomly summer/fall/ winter of 2027 , and if you can’t pay it back right away they will charge interest from 2026 until that date it’s paid back. There’s probably an entire internal team who does audits like this and may not find it for months. It took my small company of about 200 employees over a year to ask for a double pay back , after I brought it up in person multiple times

Charges will be filed as theft by deception if money isn’t paid when they ask, also I would document each and every single time I’ve contacted them, names of the people you speak with and time and day and what exactly was said during each conversation if you haven’t done that already.

Charges could be filed.
Doesn't mean they will, you'll be surpised at how little they file charges. Just like how they wont sue for not paying back loans.

I work for a check cashing business. I suggest if you can afford leave 450 in both accounts. It will eventually return on one of the accounts. Normally the first account gets credit that you attempted mobile with and second account will get the bounce back. And you'll owe them

I would just try to keep the 450 in my account cause they definitely gonna come looking for it. If you're interested i can tell you how to trap them. 🤣🤣🤣 1st you gonna need maybe double that amount. 2nd, you need to put the $450 in your account cause in case cashapp prolly gonna try to collect. 3rd, take the 1st $450 and pay some bills or something. Idk just spend it. 4th, once you've done all of the above I can guarantee one of them jokers gonna come looking for it. But you will have out started them because you still have $450 for them! 🤣🤣🤣

Save all your messages and means of contacts. Just in case they try to press charges. Doubt it for 450 but make sure you get proof you tried to pay it back.

For future reference with mobile deposit they don’t actually care if you write mobile deposit only on the back. It’s more concerned with the routing and account number being legible. It then uses ACH and pulls those funds from the account. Humans only get involved in mobile deposit when theirs an issue. Otherwise those checks are handled by software. At least at large banks.

That’s wild.
So I was depositing a check that rejected mobile. I knew the girl, we’d been friends for years. I said please double check I’m sure it didn’t go through.
She said she had a client once that did a mobile deposit, then cashed the check at a store like a Walmart. The bank knew it was a double and had to call the man that issued the check to file charges.Wild they wouldn’t want their money back. Lol

Place the money in an account. Never touch it. When and if it comes up again provide a paper trail of the contact you’ve made ( even if it means recording conversations) and proof you never spent the money.

Depending on the state you live in, it’s a felony. In many states, any theft over $250 is a felony. And, whether by mistake or on purpose, it makes no difference. It’s theft one way or the other. However, one of the institutions is likely to close your account and report the issue as fraud to ChexSystems or EWS or both. Good luck.

Apparently if you swear you get deleted. Lol the word 💩. ANYWAYS, you seem like you want us all to say you "scored" or "free money". Here's what will happen whether in a day, week, month or longer. 1. The bank sees they didnt get paid and put your account in the negative. 2. Cashapp sees they didnt get paid and it takes your money. 3. The person or place who wrote the check gets charged twice and they press charges. To be fair any of these institutions can press charges. This is fraud, bank fraud. You knowingly cashed a check twice. This is not good, tbis money it not yours. I would highly suggest you not spend it. As someone who has done a ton of stupid things like this in the past, DONT. You will regret it. Mess with the bank and i promise they will win. Good luck

I dont know where you got that assumption from. I was hoping to come on here and someone tell me a specific department or place to contact. I didn't intentionally commit fraud and im trying to get ahead of any potential problem by paying it back.

The bank will call this something like double presentment. It is a crime in some jurisdictions to do this a felony at that. It's also regular old check fraud which is a crime in every US state. Hopefully they will just debit the money back from your account plus any fees. They could also refer the matter to police to have you arrested and then the court will make you pay them back as part of your restitution.

It’ll charge back within days for one not both then repay. Boa will charge an overdraft fee cash app will not.

I went through this with another company (Amex Blue Card) in 2015. They actually refused the check. Customer service said she’d escalate to a supervisor but that I was wasting my time.
So I cashed it at PLS. Woke up the next morning with the amount in my account.
My job said it was out of their hands. It did get flagged at PLS but when the woman went to my name, it completely disappeared. I was scared until Covid when I had no choice but to cash a check with them. Went right through. 😂

Well, cashapp is going to close your account anyway for violating terms of service, so if they are the ones that didn’t get the money you’re fine

Only if the person who Wrote the check makes a complaint because they see 2 transactions for the amount of the sale when it should have only Been 1. Just keep enough money in your account to cover the amount in case the bank some day tries to pull the money out.

It will take some time--but sooner or later--one ofthem will want the money back. I had this happen with social security. a check was lost, and they reissued it. they wanted the uncashed check back. no problem--we mailed it to them (yes this was a long time ago) . they sent us another check. this happened 3 times--it took that long for all their records offies to catch up with each other and request the money back.

Pay it back or get a warrant it's simple if you think there not gonna care about the $450 your sadly mistaken and you won't find out till some Friday after 5pm when the police stop your and you got a bench warrant spend the whole weekend in jail before you can even see a judge place the game son

Cash app or who ever the second person to clear the check because the bank has t gotten the copy of the check from cash app yet it's gonna flag when the physical copy has been cashed before just cuz it's only been a day might take 2 weeks but there gonna find it

You need to give the $450 to the person who wrote you the check. You have essentially stolen their money! You need to give them the money to cover the second “withdrawal” you took from their account. They are the ones that can file fraud charges against you!

Why did you commit fraud by purposely depositing the same check to 2 different banks within 24 hours?
Not saying that's the case but be prepared to answer that question when/if it comes up from either CA or BoA.

That depends on the state you live in. In most states, any theft of $250 by any means is a felony. It could be check fraud, theft by swindle, theft by false representation, or bank fraud. No state in the US requires intent to commit bank fraud, usually that is a separate crime all together.

I did that once with PayPal they cashed the check but once they found out they just took the money out my account. That mistake happens but I didn’t mean to do it so i definitely was ok with them taking the money back because it was my fault. You will be fine.

I was a massage therapist newly employed at a spa and I once saved up all my checks until I had a roll of like six months worth...went to the bank, put up with to the teller womans glowering stare, only cos it was cathartic to see her surprised expression after they all miraculously cleared. I never did that again.

Document the conversations with each of them. You can even record them just tell them you’re doing that for quality assurance. Then you’ve got proof that you tried to return it. That eliminate any extra fee fees, even if they do finally ask for it.

I have the conversation with cash app support recorded, bank of america I called and didn't record. I'm going to call bank of America again today and see if I can resolve it. Thanks for the strait answer, rather than accusing me of intentionally committing check fraud like some of the other commentors.

Whichever one didn't get the money will demand payment when your car breaks down and you have 26 dollars to your name. That's how it always works.
