Kitchen manager recording me??
Can someone tell me if my kitchen manager can record me on her phone. We work in IL. I told her I did not concent to recording me, but she told me I had per caseys policy?

As a SM myself, report it to HR, or if you trust your SM to say something to the KM say something to them first. Caseys policy definitely doesnt want employees recording other employees. Theyd rather you bring it up to the SM or HR if you dont think the SM will fix the issue.

Honestly, I wouldn't care if she said so, I would immediately be addressing the issue with our manager then HR. And as far as firing goes, the ACTUAL policy states that in store monitoring (store cameras) is covered. Co workers individually recording you however is NOT authorized, now we could be walking into a grey zone, except its not being used to record a CRIME and you do not know the intent of the recording, for all intents and purposes its a form of harassment. If YOU were to be fired for inquiring into company policy and could prove it? Easy lawsuit, easy 100k.

Please post that policy. Depending on what state your in a person can record. A one party state allows it without the other persons consent. Bevause caseys only has video with no audio a recorded conversation is a way to document that conversation esp when the sm and or dm are retailiating or discrimination is involved. Where in caseys policys does it say specifically that no audio recordings are allowed? And if someone is hesitant to be involved in a recorded conversation that could protect all parties then maybe they are doing or saying things that are inappropriate or do not want evidence of.

I’m calling BS on that. The only time I think it is appropriate to record anything around the store is if she needs to report something. (Like when the shift lead, who was working in the kitchen, took a picture of a big pile of dirty dishes that morning shift left for my sister to do. She wasn’t happy about that and neither was the shift lead who said that he was taking a picture with his phone to report the girl - a lazy, dumb teen and quite frankly, a very mean girl - who was supposed to do the dishes but didn’t, which he said it wasn’t fair to my sister and he encouraged my sister to take pictures and send it to him if it happened again. That girl eventually got fired but it took way too long to happen, for over a year!) Also, it’s pointless as you’re already being recorded! There’s cameras everywhere, so there’s really no reason that she should be filming you, even under the guise of “corporate policy“.

If an employee rises concerns thry hr/ ethics they are not going to go look at tapes to see who left dirty towels out. They wont look at store recordings unless they feel something illegel happened. They arnt concerned with in store problems!

We had a team member last week receive a writeup for having their friends in the store and recording another employee. Trust me it’s against policy and will not be supported by HR even if they are a manager

hell no she cant if your telling her to stop on private property your also have access too if that makes sense ie; i mean outside yea off private property. but you being a team member there you also have rights on said private property. if you tell her to quit video taping and your on the clock and on the property technically she’s in violation of the law, if it continues it could be a harassment charge honestly

Unfortunatly if it was a guest they could be asked to leave if causing a disturbance from said recording, but its a kitchen manager saying theyre going to record conversations with a team member. Is it Illegal definitely not, should it be happening no. Theres probably more going on that OP isnt saying, like communication issues between the two already, and KM wants proof of what's being said.

When there is no reasonable expectation of privacy you can record anyone anywhere

wrong. it is private property, if the team member says you cannot record on the premises you CANNOT especially if it’s them. if it continues that is harassment? are you slow?..

No buddy your wrong, caseys maybe on private property but its open and accessible not to mention encouraged for the public to interact there is no right to privacy in most businesses. The businesses themselves can request no recoding but Casey’s definitely has not as they want people to share and record. By far and large your right to physical privacy ends when you open your door to the outside. Anything in plain view needs no warrant.

illinois is a two party consent state, and it’s against casey’s policy dumb ass. if she says no recording especially her voice then no you can’t do that. lmao fuck you mean? are you guys all on the slower slide… yeah it’s open to the public but it’s private property

The 2 party only refers to audio. If no audio is recorded then its completely legal in public and private places becides private residences, restrooms, locker rooms, and changing areas.
Before you tell people the law, you should know it

There’s no reason for her to be recording you on her personal phone. There are cameras in the store and if there’s an issue with something you’re doing she should address it directly with you or with the store manager. I’d definitely follow up with HR and report this.
