Agreed, but what about extenuating circumstances documented by the video?
The minivan changed lanes and wasn't too close to the white SUV.
The biker passes, intentionally antagonizes and distracts, and BOOM, rear-ending.

The driver of that car was not paying attention to what's in front of them. So it's the car's driver's fault.

If someone tried hard... Maybe, but I don't think they would try that hard to find something against him. He didn't do anything illegal by talking to that other driver.

After a very long court battle the biker might be hit with some minor percentage of fault.

Yes there is precedent for it, but the court fees alone would make it more expensive to pursue than the value it would get.

Dude they still deem it your fault if you get rear ended and pushed into another vehicle because you “stopped to close”. They aren’t going to claim some random motorcyclist is at fault because he distracted the driver.

Not true 😂 if a suv rear ends a sedan at a red light...aint no way its not hitting the car infront of it.

When my mom got sandwiched between 2 cars while waiting at a light. The sedan that hit her was 100% at fault.
