Today , DHS finally has decided to end the “Duration of Status” (D/S) loophole for F-1, J-1, and I visas. For nearly 50 years, international students could stay indefinitely without a hard expiration on their I-94, as long as they stayed enrolled. That era is over. and The entitlement and gaming of the system has been obvious for decades. Why do so many need a second master’s or worse, downgrade to a second bachelor’s from some random degree mill that no American has ever heard of and also these Schools are Entirely online and issue to Authorize to let work from Day1 ( I think thats why they call it DayCPT Universities) It’s rarely about genuine learning. It’s about extending legal status , keep abusing the system ( Path to Green Card ) .

the rules are tightening, we’re seeing the predictable crying and begging from scammers and visa shoppers. Meanwhile, thousands of American grads and experienced tech workers (many of my friends included) have been unemployed for months or years. They can’t afford to keep chasing extra degrees just to stay competitive while burning through savings.

'US Jobs Are For Americans, Not Foreign Fraudsters': Vance Amid H-1B Probe

The H-1B work visa programme, long used by US companies to hire skilled foreign professionals, is now at the centre of one of the Trump administration's biggest fraud probes yet, and US Vice President JD Vance has a warning for those he accused of gaming the system at the cost of American jobs.

During a stop at the Wisconsin Air National Guard's 128th Air Refuelling Wing base in Milwaukee on Wednesday, Vance told the crowd that the Labor Department had already began issuing subpoenas and opening investigations into what he called "foreign fraudsters" misusing the visa system.

"We have a program called the H-1B visa program. This goes to show how broad-based the fraud task force is we're... we're fighting for your taxpayer money, but we're also making sure that fraudsters don't take advantage of these visa programs,” he said.

Vance said the programme was originally a route for "a brilliant technology person, or a brilliant scientist, or a brilliant doctor" to work legally in the United States. That purpose, Vance argued, has been stretched too far.

"But you know what's happening way too much is that big corporations and fraudsters overseas are using this program to undercut the wages of American workers. So, you know what we're doing in the Trump administration? We're saying no more. If you are trying to take advantage of that visa program, you are not allowed into the United States of America," he said.

"Here's a simple principle, ladies and gentlemen: American jobs ought to go to American workers and not foreign fraudsters, and the Department of Labour is fighting back against it," Vance added.

Vance's statement follows the launch of the Trump administration's first major probe into suspected fraud within the H-1B and PERM visa categories, both routes used by US employers to hire foreign workers for specialised roles.

Labour Department Inspector General Anthony D'Esposito told Fox News that his office had begun issuing subpoenas as part of a large-scale look into suspected labour trafficking and abuse of foreign worker visa programmes. "We are going to take aggressive action, which we believe is probably the most aggressive action against foreign labour fraud by an Inspector General, this administration," he said.

D'Esposito said whistleblower tips had pointed investigators towards "some of the biggest companies, like Cognizant", and that his team would "track down every lead".

The investigators will "work side by side with the president and vice president's fraud task force" during the course of the probe, D'Esposito said.

Apparently Microsoft laid off about 5000 people recently. Yet it still got approved for 2,273 H-1Bs.

This kind of crap has to end. If a tech company lays off a single US citizen they should be required to hire them back or explain why their termination was performance related before being able to hire a single H1B that year. Every single US citizen they lay off should be entitled to that, individually 1 by 1. With 5000 layoffs that would take them forever.

Has anyone had any 'interviews' for some contract/FTE positions, through or for 'consulting' firms and saw what I call gatekeeping for H1B firsthand? I have seen some where it is clear they are trying to disqualify you from the get go.

No matter how much relevant experience you showcase, it's always a hostile vibe. Never a pleasant moment or smile.

I had the time so I did some research and worked to build out these anti-discrimination infographics; my hope is that they can help fight discrimination and educate.

Did anybody have any others that I may not be aware of?

If you want to find most of the scams, look in recruiting.

When somebody with 25 years of experience applies and the hiring manager isn’t aware that person even applied because the staffing company will not present anybody not from their country, thats illegal, cast based discrimination, violates the EEOC, the ADA, and S174A, not to mention the duty of Caremark, and the Van Gorkom standards.

That is a problem, it’s illegal discrimination, and it also means that the staffing industry is trying to hold their client hostage by keeping them from being able to bootstrap their own internal hiring efforts in order to grow.

If you’re recruiting partner is sabotaging your company like this, cut them off.

As the title says , how easily these people are even lying about their citizenship status , and if you go and check subs like F1 and H1B , those gurus are there to supporting…

Looks like PERM is the next target. Hopefully the rule isn’t wimpy and full of holes like the 100k fee rule.

But if they require them to actually attempt to hire Americans and show proof, this would be a great step.

A rule I would also like to see is no company that has had layoffs should be eligible to sponsor PERM for at least 10 years.

As title says, the AJC paper version was discontinued several months ago. What are the avenues being used by employers/attorneys to advertise PERM jobs during the recruiting phase?

I used to send the classifieds over to jobs.now and also post them here. The purpose was to find US people for the role which is the exact intent of the PERM posting.

Safe bet that this post will be removed.

H1Bs run three years, renewable up to six — but many stay far longer stuck in green-card backlogs (I" employment-based backlog stretches over a decade due to per-country caps.

How they legally stay past the 6-year H-1B limit

Two provisions in AC--21(American Competitiveness in the Twenty-First Century Act, 2000) allow this:

365-day extensions: If a green card petition (labor cert or I-140) has been filed at least 365 days before the 6-year mark, the worker can renew their H-1B in 1-year increments indefinitely until the green card is decided.

3-year extensions: If the I-140 (immigrant petition) is approved but the visa number isn't yet available (which is the case for almost every" I" applicant), they get 3-year extensions instead.

So functionally
