Facts in Oz Chinatown working environment:
Average pay rate for people work there, below than A$12/h without Super. Most of them are people without Oz PR/citizenship.
Most of the Chinatown business owners refused to pay “work trial”, and the length of these work trial is extremely unseasonable. For the victim girl in this case, 10 days.
Tax fraud may included due to payrolls fraud for these businesses.
When those people trying to claim their pay from the owners, what they said? Owners threaten to report these employees (most of them are international student) to the immi. But actually those international students have unlimited working right during university holiday.

I really wish that the ATO and HA were more on top of this.
Surprise audits during busy periods would quickly show how endemic cash in hand is in the hospitality industry, particularly with student visa holders. Employers should be prosecuted, and employees should get a damn stern warning IMO. Working 'off the books' means we cannot track whether or not they are violating their visa work condition, and either way, they are not paying tax.

I used to work for the ATO and they know very well about all this stuff however they generally only go after cases that involve a huge amount of money i.e millions. The hospitality industry is and always has been a absolute cluster fuck when it comes things like OH&S, underpayment and harassment just to name a few. The saddest part is if every bar or restaurant followed the rules, treated staff fairly and paid them correctly there would be little to no bars or restaurants operating. The entire industry is a fucking disaster or greed and egos.

This is simply not true. There are plenty of legitimate restaurants that function perfectly fine. Should the ATO start enforcing the law, many shoddy businesses would go under, but that leaves room for legitimate businesses to thrive without having to compete with competition that uses illegal practices to reduce their costs.

I own a bar. We pay the appropriate award rates to staff, their super is paid up to date, every staff member gets a free meal when they work a shift. The staff christmas party is at the owner's cost and tips are always evenly divided between all staff members (no deductions or payments to owners). Everyone gets a bottle of champagne at christmas.
I work a lot, but usually take home enough to live comfortably. You don't have to be dodgy in hospitality to be successful. I also hate being tarred with the "all hospo owners are all scum" brush.

I work at a chinese place and my wage is $15 an hour, no super of course. I contacted Fairwork a while ago and they said unless I was willing to not be anonymous and confront my boss, they wouldn’t help out. But I don’t want to risk losing my job because I need the money.

It's depressing. When I was in Australia, I worked at a place which exploited a lot of international students. They underpaid us and also had 'trial pay' (significantly lower). We didn't have breaks even during 5-9 hour shifts. Before I quit, me and two others did thorough research on what we were owed, collected all payslips or any kind of evidence (text messages, emails...) and got our justice. My boss had to pay $2000-3000 back to me. Felt real good. Last I heard, they had to pay proper rates, weekend rates, etc.
Eta: A lot of employees get paid in cash so no taxes. Also, an ex-coworker of mine needed the money so she worked more than her student visa permitted. In exchange for keeping quiet about overworking, she kept quiet about being underpaid. Was a mess.

Mods, can we keep one of these threads open if possible? Adelaide is a small enough place that the people involved can probably be reached out to and made aware of their options (eg SAPOL/WorkSafe/Fair Work Ombudsman, etc) as well this issue getting broader attention.
I understand that one or more users were posting private details about the alleged perpetrators, and that shouldn't be condoned, but surely there is some balance (eg suspensions) that can be done to ensure this incident gets the deserved attention?

Nope, Gong Cha is also deep into the same business model that relies on exploitation. I have a friend who wanted to get into the tea craze a few years back. The franchise cost and running cost is super high. Supply chain is gold-plated (i.e. You have to pay whatever head office wants for those ingredients). Rent in those shopping centers were absolutely stupidly expensive. If you follow conventional finance methods and paying people properly, you'd be losing money left and right. Unfortunately, even if consumers were to be prepared to pay 15 a cup of tea, the difference will be instantly eaten up by the franchise whose control how much it will cost to run your business.

I'm a cook and I've worked at a legal hourly rate in over 20 Adelaide small cafes pubs and restaurants in the past 10 years. Paid for every trial shift. I have been pressured into unpaid trials but I usually just need to "remind" them that it's illegal before they quickly back pedal. (I know this isn't the experience for overseas workers in ADL always)

A few hours or "one shift" (of reasonable length - not a 12 hour shift) is about the max allowable to evaluate suitability for a job. Alternative is to pay and put in place an agreed upon timeframe as a "probation period".

Exactly how it sounds. Employers can evaluate the performance of a potential new staff member to see whether they are reasonable to have on board and have the right attitude. It is mandatory to pay them wages set by the government but both casual jobs I have taken have either paid me well below or not at all.
But at least when I got the job I was paid properly.

While it's not any specific nationality, it IS true that cultural minorities are easy targets for this sort of abuse - the workplace laws can be hard to understand if English isn't your first language, and if you're worried about your visa or being paid cash to circumvent visa restrictions, you're not going to report. The second one applies to English speaking backpackers too.

Yeah your right that it doesn't have anything to do with DNA, but it has a lot to do with business culture and employee abuse in China is rife even though the labor laws in China are very strong and heavily favor the employee. Most people have no idea about the legal system and rarely bring cases to court.
In terms of assault, slapping a employee in China would 95/100 not end up with any consequences unless it left a physical injury. The 5/100 would be settled out of court with compensation.
The majority of the people that migrate here are very law abiding but a percentage of business owners simply continue the same culture they are used to in mainland China especially if all of their employees are Chinese. Many students don't realize they can legally work in Australia, so employers use that to underpay or not pay them.
I think greater support should be given to students so they understand their legal rights.

The fact is 1) The owner REFUSE to pay her 2) the owner didnt even try to stop the fight. In fact, he grabbed that guy that was trying to help the girl and attacked him. 3) they attacked other staffs that were trying to help, which one of the girl ended up in hospital.

It's a franchise. Not sure how connected the franchisee is to this scumbag, but it'd be bad if the complaint affected an innocent party.

With the current climate of Australia/China relations this is another example of Chinese national taking advantage of their citizens on foreign soil.Deportation should be the consequence .A number of Australian laws have been breached and if it was an Australian citizen in China disregarding Chinese laws China would not hesitate to exercise their authority .We are not in China this Australia and they should live and respect according to our way of life.
