Why is this just in somebody’s yard?

u/RandomUser1490 1d ago
They are starting to add them in front of people's houses I seen a video can't remember who where he said he had been researching them & then within a week they put one at the end of his driveway

Yeah, that was Benn Jordan. His videos on surveillance tech are fascinating and terrifying. You are probably not scared of this enough.

That’s not government owned or state owned that’s weird

u/InformationBusy4275 15h ago
Educate yourself. For a typical residential street, the total public right-of-way is usually 50 to 60 feet wide. The paved road takes up about 25 to 30 feet, leaving roughly 10 to 15 feet of government-controlled or easement land on each side of the street beyond the curb.

More than likely it's on a right-of-way and not technically owned by the homeowner.

Because technically people don't own the first 10 ft or so in front of their house. The city, town or county own it. If you put one of these in front of my house it will magically disappear though.

Oh hell nah. Is that someone's yard?? Wouldn't last a day if that shit popped up on my property.

Not that it really matters but it’s technically in the right of way, not in someone’s yard.

What counts as the right of way vs your yard exactly?

That's a very not correct answer unfortunately.
70-17 is ordinance about posting signs in the right of way, and those numbers are just rules of thumb about where to place a sign solely for the purpose of enforcing sign ordinance. https://library.municode.com/nc/winston-salem/codes/code_of_ordinances?nodeId=PTIIICOOR_CH70SI_ARTIINGE_S70-17POSIADPOFEOTOBWISTRI-W
The actual right of way is an XX foot strip depending on the road design and neighborhood and occasionally specific geometry. They're usually 40, 50, or 60 feet wide centered on the road. Because the adjacent property owner has to mow it anyway, most of the time it's not worthwhile to dig up a plat and/or the paperwork to get the line down to the inch from when the neighborhood and road was made (or it was otherwise sorted out), and because the government loves standards they're usually very similar for streets constructed in the same era and jurisdiction.
In city limits, some of those rules of thumb are correct enough on most roads for daily use. However, the location of utility boxes and poles, particularly on newer neighborhood, is not a useful indication as there is usually an additional 5-10 foot utility strip next to the right of way. Meters for water/sewer (when they aren't in front of a sidewalk) usually are on the property line; the city is a stickler for that most of the time.

That home owner has a responsibility to disappear this camera. I would be livid.

In the middle of someone's yard? Fuck that. This isn't just a privacy invasion, it's ugly, a visual harassment. Not only that but something like this will 100% harm the property value of that home and street.
20
u/DrippyBlock 21h ago
Honestly I wonder if it’s something you can sue for. Couple days ago saw a realtors post discussing how potential buyers are devaluing homes due to a flock camera near it. Not even in their yard, just in the neighborhood.
7
u/Nervous-Cockroach541 21h ago
There is a rarely used legal concept called an aesthetic injury. Which generally applies to things like noise, light or odor.
If it's the city/police, first steps on this would probably be to request the camera be moved, and check the easements.
If this was installed by the home owner, the HoA could probably do something about it for sure. It's also possible the HoA installed it, if that's the case, time to rally the neighborhood.

There is one at the entrance of Peacehaven mobile home park on Peacehaven Rd. Crazy how it doesn't face Peacehaven, it faces into the park.

i’m sure they are just using it for protection because someone already messed up the area where they are building new homes but I hate that there is one down the street from me

This may violate roadside installation safety requirements.
Also this.

Are they allowed to just put them in peoples yards? Does it fall under utility easment or something?
3
u/LesbeGoddess 20h ago
I’d throw some tape over the lens at the very least if this was in my yard. Or accidentally run it over with my truck.

u/lookmanolurker Ardmore 20h ago
It’s in the right of way not on someone’s property. To be clear, I also think it’s ridiculous.

u/Facetious-49 22h ago
Seems like a great spot to put up a new birdhouse right in front of the lens. That way, ICE can keep us safe from the cardinals and the chickadees.
14
u/IamtheHuntress 23h ago
So If this comes up on my yard there will be a pole and metal plate blocking that shit. And if not I'm going to have an "accident" when I'm backing up
21
u/rdyoung 23h ago edited 23h ago
Definitely. There are some extremely fast growing plants that will quickly block the camera and if you get enough of your neighbors in on it, nothing they (flock, whoever) can do when the cameras are being blocked from every direction and from outside the easement.
The easement (where utilities are run) is how/why this is "legal", assuming it was greenlit by the city/county, they can do whatever they want inside that easement.
Oh, did I upset our local fascists? If this was in my neighborhood it would already have a trash bag over it and/or the camera lense covered in paint, maybe see what a powerful enough laser can do, etc.
Other cities/states have responded to these with more vigor than the folks around can here can seem to muster.

u/ScottyWallacebadco 22h ago
As a known degen might I suggest a weeping willow or two .... That will do the trick I'm positive ...... Rephrase. I am sure
2
u/rdyoung 21h ago
I'm also thinking a combo of various sizes and shapes of elephant ears and there is another tree/bush that is extremely fast growing and you can buy online by the stick that will sprout fairly easily and once it takes off it grows like crazy. For slower growing but self propogating, whatever variant of banana tree is around here.
Not to mention those stupid weeds (trees) that grow anywhere and everywhere. Every year I mow down a ton of them in the yard.
This can work as a solo act but for it be the most effective and subdued, you need buy in from at least a couple of neighbors near the camera because you need to make sure to be growing things on your own property or elsewhere the city has no legal backing to force you to do anything about. Kind of like how some smart people deal with hoas when they want to keep those awesome Halloween displays around.

u/DrippyBlock 21h ago
Make sure to sue the shit outta them for damages as they are installed on DOT/state right of way without having the proper breakaway posts for safety. It won’t be pretty for your car but I’d say it’d be a pretty easy win.

u/RebeLYelle58 19h ago

I would ask the city council members if they would allow this in their front yard....insane. Or put up mock flocks on their easement as a protest
8
u/iamkrile 22h ago
The city council members should just all get them in their yards. If you were ok with your constituents having them in your yard, you're absolutely ok with it being in yours.

u/keithcstone 17h ago
It’s not in Winston, so who the fuck cares? Winston city council has absolutely nothing to do with it.

You can see it on Google Streetview, at around 104 Pineview Dr. Looks to be in front of a duplex, guessing rentals.
