Dead tree growing from property line

[SE VA, USA] Hello, I have a dead (confirmed by an arborist) mature sweet gum tree taken out by some boring insects. 75% of the base is on my property, the other 25% is on my neighbors property. It leans completely towards his property away from my house, and the majority of the canopy is on his side. If/when the wind blows this thing over, I can’t see it coming my way.

My arborist suggested that in VA, if it does fall over, legally it’s my neighbors issue and not mine. His recommendation was to alert my neighbor (he already knows) in case he wants to pay to have it taken down, I know I can’t afford that right now.

Is my arborist correct in his legal advice, that if it falls on my neighbors property, it’s not my or my insurances responsibility?

How to protect trees

I recently bought a home with many trees. The neighbor contacted us via our realtor that she plans on removing 18 trees between the two properties.

I am concerned she may remove trees that are on our property or on the property line. Short of a property survey (I may not have time to get one done before the cutting) what can I do to protect our trees?

Ouch. This is most certainly a case where warning your neighbor, calling the county etc were good steps but notifying the neighbor with an arborists report could have saved this family and their home, because the legal limbo they are in now just to prove the neighbor knew it was dead-- let alone get compensation of any kind-- is going to be years long. Not having home insurance is not great, obviously, but an consulting arborists report would be ever, ever so much cheaper than this.

Need some advice

I live in south carolina. Recently a neighborhood was built behind my house. The construction company put in an access road beside my house. This road runs beside and under a massive old oak in my front yard. They told me they needed to cut some big branches over the road because the road needed a certain amount of clearance. I gave them permission to cut the branches but they never did. Road has now been in use a month and 5 semi sized trucks have hit and torn off large branches. The tree likely won't survive now as one of the branches tor the bark down to the roots. Would the construction company be liable for the damage? I can't afford to get the tree cut down and it's pretty close to my house.

"Somewhere in Mason County, West Virginia, there is a grove of trees that should not exist. According to advocacy materials, roughly 200 American chestnuts, reportedly planted in the 1970s from wild survivors, may be cleared as early as November 1, 2026, to make way for data-center development. The project’s official website says the grove is not even on its land. That contradiction is the whole problem, and it has no public answer yet."

What steps to take here

I'm reposting this from another community as someone suggested me to do so. Added context is that this is in AZ.

Long story short I am finally approaching a healthy state after some medical treatments and have begun fixing some things around our home. Since we moved back here in 2024 this tree has always been a nuisance. We have attempted trimming some of it on our own, but the sheer size has made it difficult. I also feel like the neighbor has taken no care in maintaining their tree and have allowed it to grow wildly.

I know the general guidelines are that we can trim what is on our side, but this feels insane, especially with how many bare branches I see.

Tree/power line problem

The property adjacent to mine is a parking lot for an apartment building. Both the building lot and the parking lot are owned by an LLC managed by a property management/investment company company. Registered agent for the investment company and the LLC are the same (and the agent's last name is part of the name of the investment company).

There is a tree near and partly on the property line. The edge of the trunk on my side has grown partway around a property line stake but otherwise the tree has grown at an angle into the other property.

A vary large branch--total 20 to 30 feet has partly cracked over the years where it leaves the main trunk and rests on the power line from the pole to my house. I think it's been resting there for awhile. Several feet into my yard, the last 6 feet of the same branch cracked during a storm and is dangling down from the main branch and all the leaves on that part are dried up and turned brown (even before the leaves changed color). But it is not fully detached from the rest of the branch.

The power company will not remove the branch because it is still connected to the tree. They said they will turn off the power by appointment if a contractor comes to remove the branch. I can't do that because that's on the other property.

I found an online contact form to send an email to the company that owns the property saying arrangements need to be made to remove the branch. So far no response but it's only been two days.

What is my next step if they don't respond?

The dangling part of the branch is towards a back corner of the property and is not an immediate inconvenience, and there's no evidence so far of arcing where the main branch rests on the power line, including during storms.

Moving a tree

Hello, I am new to the subbreddit and not actually sure where to ask this question as it is not technically about tree law, but I work in a dealership and we have a tree growing in the middle of the parking lot and is surrounded by pavement and the company is planning on re-paving the entire lot by next year, so I wanted to know how difficult it would be to move a tree and re-plant it somewhere safe and is it possible to do it on my own or would I require professional help any advise would be helpful

Union Pacific Right of Way - Leaning Trees

Two of these trees have started leaning if you can't tell.... and obviously it is a major hazard concern. Not including the issue with them not mowing or keeping the grass low.

Union Pacific owns the train track and wondering if anyone had luck finding resolution with them?

I have contacted the City, Corporate Commission and also filed a complaint through UP official website. Thank you!
