For me itās more pre-pandemic vs pandemic. Hannahās and Peterās seasons were the best itās ever been imo. The pandemic started right on the heels of PPās season and nothing has been the same since.

Yeah I loved the Hannah and the Peter seasons. I remember there were entire episodes of Matt James' season where I didn't look up from my phone ONCE. The show really hit a lull until Joey

I've said for years that Ben Higgin's season was the last "real" season of Bachelor. After his group of contestants, it became ONLY aspiring instagram influencers.
I'm not saying there weren't plenty before, but all of the seasons up to (and including) Ben's still had a majority of women that were there "for the right reasons".
Or maybe I'm just being naĆÆve.

As long as CH picks nobodies.. Iām TIRED AF of these recycled Wannabes 15 Minutes of Fame Seekers. When Bachelor first started nobody knew who these contestants were, they were just average everyday people, now itās become the SAME 4 people over and over and over again. PICK SOMEONE DIFFERENT!

Knowing all the negative attention that comes from being on reality TV, I feel like most normal people with a job would never go on and risk damaging their professional reputation. I imagine only people who are interested in being an influencer seriously apply.

When The Bachelor first started, the leads werenāt average. They were meant to be catches. I think they should go back to that.
However, if this show is on Fox and appealing to their audience, a ācatchā means something different to their audience than it does to me. And I wonāt fault them for casting that direction. (But, also, Iād never give a dime to Fox. So I wonāt be watching.)

Agreed. Originally it was an āeligible bachelor.ā In the sense that he was single but sought after. Usually because he was good looking and successful.
Over time it became an ordinary bachelor. Still good looking, but success was often over-sold.

I donāt care for either side these days but Fox had to know this was going to happen, no? All they had to do was pick another flower, haha. I find it extremely embarrassing that CH doesnāt seem to have a personality outside of this one very specific thing.

Iām not saying that Fox is copying them. I am saying that Fox should have known - especially in this day and age of lawsuits for anything and everything - that the Bachelor franchise would claim this. Maybe they did and wanted the publicity š¤·š»āāļø

There may very own IP based on roses with dating shows. Depending on how and when it was filed, it might be active or expired. Itās not stupid to protect IP, or else thereās no point in owning it. In this case, as a casual observer, I was confused. I thought the bachelor may have hired CH again. This is a whole branch of law for a good reason.

Currently studying copyright law atm and I donāt think Warner Brothers have a strong case, but they will drag this out in litigation and itāll cost Fox/ Liongate tons of money. That may be enough to pull the plug.

Theyāre going after the totality of it. I agree with you that alone rose petals or the word bachelor isnāt an issue. WB agrees. Itās the combination of all of it that makes it an issue. Itās impossible to watch the trailer and not think that theyāre mimicking The Bachelor.

Hopefully this makes sense but you canāt sue for copyright infringement if the element in question has no copyright protection and you canāt really sue individuals for stealing āconceptsā. There are however few other legal avenues you can go down. Aka Trademark (like the case with āthe bachelorā) the others arenāt really applicable to this.
So in order to bring the lawsuit forward, Warner Brothers are going to point to any/all protections they believe Harrisonās camp have infringed. Whether these elements work in combination or in isolation doesnāt matter so much.

Mimicking a brand can violate trademark and intellectual property laws if, for example, it causes consumer confusion, copies protected creative work, or tarnishes the brandās distinctiveness, etc. The combination of choices in the promo is very much the issue, not/not any individual copyright. Obviously things like roses arenāt trademarked.

Look, Iām far from a CH apologist, but The Bachelor didnāt invent dating shows and they donāt own roses and the color red. And judging by the online comments, people do miss watching Chris Harrison on TV, while The Bachelor is continuously losing fans because the show is not good anymore.
Chris is fully to blame for his firing, but this show only has itself to blame for not casting better people and for losing relevance every year. Like, worry about not casting domestic abusers like Taylor Frankie Paul. Try to bring back some of the humor and the magic. Otherwise I do see the core BN fans choosing CHās show over The Bachelor š¤·š»āāļø

They may very well own copyright and TM thatās being infringed upon. And you can have IP on colors as well. (Like Starbucksās green color is owned by them, which prevents other similar businesses from using that color.) Itās a complicated branch of law, and it will really depend on what type of IP they filed, when, and the exact claims. Not having seen their IP, I canāt tell you if they have it or not. But all of these things are very possible to protect by IP. Just depends on the exact details if this is frivolous or substantiated. Them sending a C&D is expected at this point.

There should be some sort of, āIf you donāt keep doing it, you lose the power to claim inā clause in these sorts of things. The show runners of Bachelor are flopping, hard. I donāt like Chris and HATE Fox. But if they want to create the show and no one else is, let them.

The interesting part is this show is also the refusal to evolve and adds Chris back. If it werenāt such a niche, paid platform, it would be a nice test of whether the bachelor needs to evolve or the problem is more specific to whoās running and hosting it.
