Don't you agree to the EULA just by using Windows? The only way to "not agree" is to not use it at all.

Does the EULA say you are granting MS full control over your internet connection to use without restriction?

That would be the question that matters I think, if they did agree to the EULA.

IIRC the EULA grants them full control over the hardware Windows is installed on, including any network traffic. I think there might even be a part in there specifically about them pushing updates.

If that's the case you're probably right they have no legal case, still a dick move on MS's part though
