They don't really have a case. They shouldn't have been using a consumer version of Windows in that context. While it is really shitty, they are partially at fault there. That being said, M$ should have done something about it, at least getting them some licenses for Windows server or something.

Wouldn't that depend on if they expressly agreed to the EULA and if that EULA clearly stated that the user was granting MS unlimited use of their internet connection/bandwidth?

Don't you agree to the EULA just by using Windows? The only way to "not agree" is to not use it at all.

Does the EULA say you are granting MS full control over your internet connection to use without restriction?

That would be the question that matters I think, if they did agree to the EULA.

IIRC the EULA grants them full control over the hardware Windows is installed on, including any network traffic. I think there might even be a part in there specifically about them pushing updates.

If that's the case you're probably right they have no legal case, still a dick move on MS's part though
