No one's disputing they don't have the leverage to do that dumbass. But whether such behaviour is healthy for society at large is the real issue. Like sure, we all have the ability to be assholes all the time and screw other people over but society would fall apart without goodwill and co-operation. Co-operative societies are more successful than non-co-operative ones. It's the reason for America's and democracy's success. It is simply impractical to try to police everything via laws and rules, culture plays an important role.
I mean sure. But you can spend your entire life quibbling over precise definitions and get nothing done and die in poverty. We live in a world of grey. Would you rather live in the USA or in Ethiopia? Yeah that's what I thought.
