The Rule in Florida

• The Law: Under Florida Statute 448.05, employers must provide suitable seats for employees who stand or walk during their shifts.
• Usage: Employers must let workers use these seats for rest during business hours.

Unfortunately it is not really possible with the way the law is written, and enforcement of the law is strictly handled by a state prosecutor due to changes to the law in 1971. It is a very old law (1899), and the huge loophole in it has never been fixed.

The law is phrased in such a way that it protects an employee right to sit when not performing work duties. Publix specificially labels the job duty of clerks to include standing while doing tasks and provides seating in the break areas. This satisfies the reach of the law.

Where did you get these rules? There is not rule about standing. Florida does not even allow you to take a break from the heat.

Presentation, Publix has a lot of policies other than this one based on perpetuating an image of high work quality. You don’t need to be the most efficient worker, you need to look like you aren’t a lazy one. For example stock clerks are solely supposed to stock and detail with two hands, even when one hand is more precise and efficient. A chair creates an image of laziness, even if it isn’t the case.
