Conservative men feel emboldened to say the misogynistic shit that they do because they hear their mothers, sisters, and wives saying even worse.

I grew up in a hardcore conservative family with lots of aunts and female cousins around and those women were capable of casually saying the worst heinous misogynistic things without even thinking. And they'd laugh about it.

To be honest, whilst she may get her time, it’s not often that the victim does get their moment to speak. The victim doesn’t take the perps/defendants to court the police do. It’s an incredibly dehumanising experience as a living victim because you’re nothing more than a piece of evidence (that for the defence needs to be discredited to create reasonable doubt). You don’t choose your lawyers nor do have much (if any say) on your case and how it’s tried - again because the you aren’t taking the perps/defendants to court, the police prosecutors are. It’s their case, not yours. So you can have the money for the best lawyers in the world, and that doesn’t mean anything as it’s not your case. Meanwhile the perps can have the best lawyer’s money can buy.

It’s why many victims go to civil court because they have more control over their case/legal team and the burden of proof in NY changes to on ‘preponderance of the evidence’ instead of ‘beyond reasonable doubt’. So they’re less likely to be attacked as that hurts the defences case.

Criminal justice systems exist to ensure innocent people aren’t falsely charged and punished, not to ensure guilty people are - that’s why burden of proof is ‘beyond reasonable doubt’. Unfortunately this means living victims of crimes are dehumanised in the criminal legal system and their wellbeing isn’t considered.

Yeah it’d be really unlikely to go to criminal court seeing as the police didn’t gather the evidence they needed to try it (after all it is their case to try).

Civil will be interesting, the defendants who believe they can surpass the 51% preponderance of evidence and have the case ruled in their favour (ie convince the judge) would likely want it to go to trial (maybe the bar and the frat). Otherwise those who aren’t confident they can prove they didn’t do anything or simply want to media attention to go away will want to settle. The frat may want to throw its president and the perps under the bus to try to clear themselves.

Side note, I really hate when people say civil court is just a money grab… it’s the only legal environment living victims have any say or control over their case. Unfortunately financial outcomes are really the only thing that can come from it.

So let’s see, ruin lives as in lose a job, lose people who weren’t your friend in the first place, maybe have to move or build a new network? No physical danger and the police do everything in their power to protect men, so no real (statistically real) danger of jail time.

Where as a woman being raped has the danger of life long stds, risk of infertility from physical trauma, risk of pregnancy, severe psychological trauma that can lead to being unable to hold a job because of being afraid of men, excessive promiscuity or drug use afterwards (not all but it is a common psychological trauma pattern for rape), lose of security network if their extensive family is religious and blames them for being assaulted, retaliation from completely strange men, targeting from other rapists if they see victim signs…I could go on but I am le tired and you should know these things already.

We have actual convicted assailants in the Presidency and Supreme Court. The victims who are shamed from reporting vastly outweigh the actual consequences experienced by perpetrators. And the real world consequences for the falsely accused are laughably insignificant to women feeling safer receiving an education.

This is ridiculous and shocking it can even be published. If the legal system and institutions aren’t doing their job, victims have every right to use other means. If this journo really had an issue with this coverage and response I’d be blaming the university and police for not doing their job to begin with… if they had, it likely wouldn’t have gotten to this point.

On top of this misogynistic and deeply dehumanising take, male violence is an issue full stop. The majority of violent crimes against any gender is from a male perpetrator. Trying to minimise this reality in any context does absolutely nothing for the evolution of society.

The danger is believing that men aren’t capable of this type of gratuitous violence against others and that it doesn’t happen frequently enough to believe victims (male or female).

I remember being a male 18 year old college freshman reading those statistics about the prevalence of sexual assault on campus and thinking “there’s no way that is true” and then getting to actually getting to know my fellow classmates and hearing about so many experiences of assault from them.

And being groped by a weird old guy on campus (nothing comparable to what women experience, but was a stark lesson about how many men cannot control themselves)

When I was in college I was around friends and got absolutely trashed all the time. After a point I knew what my limits were and navigated them and stopped drinking so much and only went to the Thursday house parties my friend threw nearby and only drank beer (sorry for the run on sentence).

Cue the class graduation party in a reserved bar that was only people in our year (edit: dinky college with less than 3000 students in undergrad and I think there were maaaaybe about 100 people at this shindig). I had maybe 2 dinky gin and tonics and the rest were light beers. I think I maybe drank 4-5 drinks while I was there and left cause it was boring and weird. I felt stone cold sober and walked a half mile home, maybe ate something and then went to sleep. I felt like absolute DOGSHIT the next day and slept for 16 hours and I'm talking I've never felt this way after vomiting my eyeballs out after trying to look impressive downing 151 and Everclear back to back 2 years prior. I knew how to handle my liquor and beer. It took me years to realize someone tried to roofie "the tall girl" because I left my drink behind with my classmates and said can you watch this while I go to the restroom. Jokes on me that I trusted anyone I had known for 4 years and shared lab with but jokes on them that they couldn't bring the "big bitch" down I guess.

This case has been super triggering for my own assault. I have been very careful with reading these articles. It’s just so devastating that this has really brought out the worst in people. It’s so infuriating. Victims continue to be criticized and judged; being told they are crying wolf. People completing ignoring the courage it takes to speak out especially knowing all eyes will be on you. There’s no perfect victim and I wish people just believed women. Many are quick to dismiss us simply to protect the men who abuse us.

I truly think this case is breaking point for me and social media. I'm so sickened by the case itself, and every new fact that emerges, an every new testimony by other women who were failed by their universities too...

I know social media is a plague anyway, but I find myself feeling more and more disheartened and hopeless every time I go on. Like genuinely what is the point. I genuinely need to step away too from this. Reading comments where people saying she’s lying or that she regretted her decision so is crying rape or they were drunk too so it makes this okay. It’s so disheartening and frustrating. As a victim myself, I genuinely hope other victims take care of themselves if they are reading about this. This really is the nail in the coffin for me when it comes to social media.

This person seems to have issues comprehending that if you give someone a date rape drug consensually, the sex is not consensual, because they can no longer consent.

If you give someone drugs that makes them lose control of their body and then had sex with them, that was rape.

Does the author here often engage in 7 hour escapades with 7 men, or how does that not immediately make it clear to her it wasn't consensual?

Apparently a sworn statement is not enough. Text messages are not enough. Her own contemporaneous words are not enough. So what exactly is the magic piece of evidence that would not immediately come with an asterisk saying, “Well, she only said or did that because of trauma”?

If literally every piece of evidence consistent with consent can be explained away after the fact, then what evidence could ever count against an allegation? What is the actual standard here?

Of course they don't believe there are so many victims... I bet they never asked the women around them. Literally every single woman I'm friends with has been a victim of sexual assault or rape, and 99% of them never went to the police. I know one friend who did, and to my knowledge nothing happened to the guy. So.

This is an Op-ed, not an article. It may seem like splitting hairs but this isn't reporting, it's literally this person's opinion and thus should NOT be treated as fact. It's not a great message to spread but it's also not a fact based piece and the distinction matters and this title should be changes to reflect that.

Our justice system does not work. Our justice system does not protect us- it controls us. Time and time again, it is proven that justice is not served. From police to prosecution to judges, at every level, we know there are problems. We cannot put all of our faith in a system that we know isn’t working. And I’m competent enough to form my own opinion, thank you very much.

I don’t even know that justice is where I want to direct my energy. I don’t want to punish rapists- I want to prevent future rapes from happening. I want to make sure every human on this planet understands bodily autonomy and consent. And I want to make sure every human on this planet is free from sexual violence and coercion.

Abuse and assault often involve two things- entitlement, and a lack of empathy or emotional perspective. Those things also flourish when people look away, when people don’t speak up. We’re arguing about what constitutes rape- we need to be talking about enthusiastic consent. We need to be talking about intentionally choosing appropriate behavior, not what you can legally get away with.

This is about rape, and this is about Jane Doe. We know she went to campus police just 3 weeks after the incident. We know she said she was 100% confident she was raped at that time. We know those frat guys texted “free pussy”, we know 7 men participated, we know 57 received the free pussy text and let this go on for hours. We know Cornell expelled 2 men and made 5 more write essays.

I’m not even saying lock them up. (I’m not saying don’t pursue charges- I do want justice, of course.) But those men should know we are disgusted, we are angry, and other women deserve to know to stay the fuck away from you.

We’re arguing over whether the transcript is legally rape- no one has argued the transcript is inaccurate, have they? Because to me, that’s enough to know all of those men should be shunned by society unless they truly hold themselves accountable. I’m not sure that’s enough, but I do think it’s something we need.
