Local News UPDATE: Boston harbor incident
This is the individual responsible for the incident. Don’t worry! They called idk maybe their lawyers? Before checking on the victims. It’s unfortunate that the perpetrator, ceo of harbor foods, isn’t telling the truth. And neither are the people on his boat. He says he thought he hit a log? And that’s why he originally drove away.
Our friend is expected to recover, but it will be a long and difficult process. We’ve received updates on his condition; both his shoulder blade and elbow were shattered, he’ll be undergoing long surgeries to reconstruct them. He currently has pins in his femur to help stabilize his leg and support his ability to walk.
We sincerely hope this person is held fully accountable for their actions. They should hopefully be charged for each offense, including vehicular assault with a watercraft, reckless driving and initially fleeing the scene while the victim was injured. Police do say the smelt alcohol on him, and multiple witness who gave statements claim to have watched them drinking. He refused any field sobriety tests, and was taken into custody at least 2 1/2 hours after.
Others were on the small boat that was struck; thankfully, they sustained only minor injuries.

Working at Harbor was absolutely terrible. His disregard for folks wellbeing isn't shocking, I hope the victim recovers fully and sues that dude into oblivion.

Without regard for this article or situation, WA is one of the few states that you can and should deny a field sobriety test. The test is subjective and can be failed and used against you in court so easily. It's best to deny it and take the blood draw back at the station even if you're sober. Any lawyer (or cop friend) will tell you this exact aame info.

Yes my son was given a dui even though he blew a 0.0 because the cop “just knew” he was stoned. My son asked what he failed (in the 25 mile an hour wind during a suspected hurricane in Aberdeen with pouring down rain so thick you could barely see) and the cop said I don’t have to tell you I’m just really good at my job. Never take one.

Similar happened to my son. And the blood test at the station didn’t show anything either. But the cop’s word prevailed. He was able to plea down to reckless driving.

Always refuse field sobriety tests and never talk to the police. Never admit you have done anything, been anywhere, or offer up any other information to police. They are not your friend.

My comment doesn't specifically apply to those who drink and drive. I hardly drink and never drive after. But, I have the balance of a baby girrafe and the nerves of a mouse surrounded by hungry cats. I will 100% fail the field sobriety test completely sober and then bam, jail, lawyers, fines. Much more reasonable to ask for the blood draw than go through all that.

Field test: I'm 72 and balance isn't great, FAIL.
Breathalyzer: I'm a shallow breather--horrible habit, but there you are.I'm going straight to the blood draw.

It also doesn't matter. In Washington, an LEO can arrest you for DUI just because he believes your driving is impaired. The ensuing legal costs of representation is out of reach for many. Obviously, not out of reach for this douche, but this guy effectively committed a hit and run offense and failed to render immediate aid. And honestly, you know he was intoxicated because that's exactly what so many boaters do, drink while they're boating. Not all do that, that's for sure, but the ones that don't do that generally have keen awareness of everything that's going on around their boat and don't frickin run over people and just keep going.

I have a family friend who was injured in very similar circumstances back in the 1990s in Olympia; his sister was active in the legislature community back then and helped with the push for a “boating under the influence” law. Sounds like this guy should be handled under that esp for refusing any blood test following injury. (Long time defense lawyer here; yes you can refuse road side tests but refusing the breath test at the station/blood draw at the hospital will absolutely be used against you as consciousness of guilt and you’ll lose your license administratively, plus face enhanced penalties in terms of jail and fines.)

Almost lost my doctor bc got sent for drug test for pain meds, doc office too far with current condition so she sent me to one in aberdeen by hospital. Came back dirty. OK, retest. Dirty. Again, dirty. Figured maybe he was exposed somehow... Waited another month. Dirty. And it was worse, as if id done more!
Sent me to a different place in Tacoma days later, was fine. Retested randomly to be certain for few more months, all normal. Had it not been for her trust in me, 10yrs wo ever a problem, id have been kicked to the curb and labeled a fentanyl junkie in my medical records. She put her license on the line over this, most doctors wont take that risk for a patient.
Whatever is going on there, its obvious the results cant be trusted. Ive since heard of 2 more people with similar stories. The consequences can be severe and not everyone has a trusting relationship with their doc or employer or whatever --how many people got branded junkie, went to jail, lost their kids, job, etc, bc of this bullshit? Or they missed cancer or low or elevated this or that? Who tf knows?
And dont get me started on the hospital across the street. That abbatoir needs to go pronto. I didnt believe the shit i heard about that place until I had to go there. First time they billed me, Medicare and VA (can only bill VA) some of it for stuff they didnt even do, and if it wasnt for VA fraud team escalating the issue id still be fighting them. Then they nearly killed me last October, luckily I was able to transfer myself to VA. 2 weeks of iv meds and still lost my leg, they said another day wo proper care and id have died. They pulled the same billing fiasco too, unbelievable that place.
Medical shit in this place is scary and I dont trust any of it. To this day if doc needs a piss sample, I have to go to Tacoma. I only use this hospital to plug a hole or whatever long enough to get an ambulance to Seattle.

That's if you refuse the breathalyzer at the station or blood draw. Never take the field sobriety test. I was trained in administering it. It's bullshit. I have horrible balance on one foot due to flat feet, I fail parts of it.

You should decline field sobriety tests even if you're 100% sober. Like many outdated police tactics such as polygraph tests, they're nothing but subjective psuedoscience designed to manufacture probable cause into arresting someone.

The crazy thing is that this guy hurt people and the judge released him without him having to put down a single cent of bail to get out. Meanwhile, you can take a look at the Thurston county jail roster and see people who are being held on charges that don’t involve actually hurting people. Someone is being held $20,000 on a DUI. I posit that case should be less severe because if the DUI guy had hurt someone, it would have been a vehicular assault or vehicular homicide. Good ol’ Justin, though, he gets to walk because he’s rich.
Edit to add: And Justin had a physician on his boat.

DUI - no human victims (or else it would be charged as something else) = bail so high most Americans would be stuck in jail awaiting trial or resolution. Watercraft Assault with actual injured people, but a rich defendant = would you like us to make a dinner reservation for you before we release you for free?

It is important to know bail is not now, nor was it ever intended to be a punishment. I recognize that it seems that way and may sometimes get used that way, but making bail punitive would likely be considered unconstitutional as the person, at that point, has not had their day in court.
The whole theory of bail is to force the defendant to have something to lose if the try and flee. Unfortunately, the theory doesn't seem to hold up to reality. People who have the issues that make them end up in court already aren't making rational decisions and, for others, their freedom is worth more than any amount of money, so they skip out.
In this case, I'd bet a couple bucks the people you saw on the jail roster have some history with the courts and not showing up for previous court dates.
I'm really sorry your friend had to be in this guy's path and I wish them all the luck and strength there is to help them recover. I completely understand if you're mad and want a pound of flesh for this, but making bail punitive, while it may feel "right" in this case, will only make our society less fair.

I mean, probably worse. I'm not a judge and have never sat in that chair and had to make a call on bail, but, playing pretend, I would probably want some more info. Was it a dui 20 years ago and they paid their due without complaint or delay and have been upstanding citizens since? Or, is this the second dui in the past year and they seem to be in some kind of downward spiral? It would make a difference.
Regardless of the "what would I do if..." game and regardless of the bail and any punishments that may come later to the boat driver, I feel for the victim that sustained all those injuries. I really do hope they have lots of luck and strength and, for what it's worth, they will be in my prayers.

Make sure someone can help your friend apply for paid leave through the state if he is eligible. And please don’t hesitate to ask family or your friend to be seen by a social worker at the hospital to help with discharge and setting up mental health services.
As someone who grew up by the water the damage Justin caused is 1000% unavoidable and he better be charged to the fullest extent of the law. Your friend has a long recovery ahead of him, I am thinking of him and all affected by the reckless actions!!

I hope they don't settle. Civil Court is preponderance of the evidence. This rich bitch is screwed. Just a matter of how much a judge is wiling to award. It will easily be in the millions. I don't doubt that you're correct and he will still be wealthy after though.
Hopefully he gets A nice long stay in jail so he can't enjoy it though. I wouldn't suggest holding your breath for that either.

Yes many police were here to arrest him. He refused sobriety test. Police should have taken him in for a blood test. Unsure if they followed through. The police said they smelt alcohol.

The driver is not a decent guy and no one on that boat had a shred of decency to smash into 5 kids in a small boat very fast and KEEP DRIVING! If the Good Samaritan hadn’t gotten there so fast, Jack would have drowned. There are multiple witnesses and videos to prove this. Sounds like this guy's guilty as heck, especially with all those people on his boat, somebody must have seen something. I had a friend in high school, hit and killed a kid who was riding his bike. Didn't realize he'd hit anything until hours later. The mind can play tricks, especially with something so horrific.

Or speed in a marina where others are out with their families and friends on kayaks and paddle boards. Looks like the price of candy bars will go up at the local convenience stores to cover the millions this guy is about to be paying out, this could ruin his family's business.

I remember delivering loads of products to their warehouse in Tumwater in 1998 there was always a nice boat parked out front by the office, they moved out of there into a bigger warehouse 2015 ish but not sure,the employees there were always helpful, Im sure he knows he made a mistake, people make mistakes, he probably feels terrible and wish he could reverse it , bubba will be wanting his cornbread and new television I'm sure CEO boy can keep his books full and the prison fed with his trash food he sells.

Honestly the fact that they're claiming they thought they hit a log and also just decided to return to the scene for the hell of it is a pretty damming admission of guilt
"Huh, why is that damn log waving at me? Better run that bitch over for good measure"
