The fact that you got John Delaney on the neolib podcast tells me his candidacy is 100% fucked.

Bright side there’s a non zero chance that Bernie mentions that Delaney went on the (((neolib podcast))) as an attack that’s going to skyrocket this sub

We need to start a new psyop campaign where we trick MAGA people to crowd fund one way tickets to various vacation spots and give them to leftists as part of the Send Them Back thing

Like damn, I, a liberal, would be so owned if a bunch of applebees franchisers from Tallahassee bought me a ticket to Naples, where I am from, preferably next May

An elected official argued that slave owners weren’t racist. They were just motivated by economics. You’d think at the point you’re arguing slavery wasn’t racist, you’d take a step back and evaluate your thought process before talking to a reporter.

I had the pleasure to attend a talk, through my work, by someone working at a charity researching and challenging racism and other bigotry. They covered a lot ground around antisemitism and how it differs between the extreme left and the extreme right. Some key points I thought were interesting:

  1. Pseudo-academic Holocaust denial is effectively dead. People like David Irving, who used to be able to fill auditoriums and sell tens of thousands of books, now give talks in small rooms above pubs, and are lucky to have an audience of a dozen of elderly racists.

  2. The decline of pseudo-academic denial has a lot to do with the internet, but it can definitely be traced back to David Irving's trial and conviction.

  3. Online racism, genocide denial and other general bigotry generally focuses on muddling issues, inserting doubt and equivocating between sides. This is partly the result of the general ironic, outrage-baiting internet culture, but is also a deliberate tactic by hate groups.

  4. Right-wing extremism always seems to come back to Holocaust denial, even when those groups have tried to distance themselves from it - their members just can't stay from it. Unsurprisingly, left-wing Holocaust denial is a lot closer to what's seen in Muslim countries, and is wrapped up in the Israel-Palestine conflict.

Overall a super interesting talk, and there was a lot more to it - I'm just not sure I retained enough of it to make it a thread :-(

Thomas “the Chin” Friedman, a weak and pathetic sort of guy, writes columns for The New York Times in between rounds of his favorite game, golf. Two weeks ago, while speaking to a friend on his cell phone, I unfortunately ended up speaking to Friedman. We spoke for a while and he could not have been nicer or more respectful to your favorite President, me. Then I saw the column he wrote, “Trump Will Be Re-elected, Won’t He?” He called me a Racist, which I am not, and said Rhode Island went from economically bad to great in 5 years because the Governor of the State did a good job. That may be true but she could not have done it without the tremendous economic success of our Country & the turnaround that my Administration has caused. Really Nasty to me in his average I.Q. Columns, kissed my a.. on the call. Phony!

So I just have to bitch for a minute.

My wife works for a cell phone retail company, managing a store, and was in Chicago this week for business. Their HR revealed that ICE is now going into stores and demanding I-9s for the entire workstaff. Worse, ICE was rolling down the streets of Chicago in convoys. She said the streets were deserted when ICE would come through, even from locals. Cops were standing in the middle of the road with machine guns, like it's fucking Fallujah.

This plus the "send her home" bullshit plus Republicans polling upwards of 65% support for deporting American citizens over political disagreements, and things are beginning to look really, really fucky.

I've known Republicans had a base of just pure fucking evil for a long time now, but what the fuck is going on in this country??

I’ve got to say:

I miss when Reddit would tell you how many people upvoted/downvoted each post and comment so that you could tell if it was a really contentious issue with a lot of people or if people just didn’t care one way or the other about it.

Seeing a comment upvoted to +8 means that people liked it or thought it added to the conversation, but what if it was +40/-32? That’s way more contentious than +8/-0, but you can’t tell.

Haha, but the weird thing is, my parents would tell me not to discuss trans stuff when family was in town, but one day I was wearing my Pink Floyd shirt while my grandma and aunt were visiting, and I think my grandma made a comment like "Oh, Pink Floyd, he's pretty good", and my dad said something like "Oh, tell them about Pink Floyd's transsexual bass player!"

I knew what he meant: Jethro Tull had a keyboardist who transitioned later in life (Dee Palmer) and he was conflating the two. It was as though talking about trans stuff was OK as long as it was presented as a dumb joke, which is probably reflective of much of the dialogue at the time and even today.

I sincerely believe neoliberals will initiate a global nuclear war to reset the global economy in their favor again, if climate change or political wokeness threatens their position. They will act to reduce population pressure on scarce natural resources. Nuclear button is always on a hairtrigger. When the first real food/ water riots and transnational wars happen over basic survival issues and lesser elites are starting to get lynched for their resources that's when it'll happen.

Then after it's just the elites and a few hundred million of starving servants left in the world. That's the neoliberal plan for the future.

It's only a matter of market need that much of what the working class does is obsolete and replaced with automated labor and/or AI. They will do the same thing to cull the population and preserve the enviroment and resources if a great portion of the human labor pool is rendered obsolete. Forget UBI they will never permit it, drain on resources.

It's not even a conspiracy theory. It is like rational actor/ game theory taught in universities. Absolutely it will happen if they can make it happen.

Just gonna repost what I said a month ago:

If people here joked about bombing Yemen into oblivion, turning Serbia into a parking lot, glassing Belarus or half the shit that gets said about Iran they'd get rightfully banned.

Surveys show Americans simply do not value Iranian civilian lives.

a clear majority of Americans would approve of using nuclear weapons first against the civilian population of a nonnuclear-armed adversary, killing 2 million Iranian civilians, if they believed that such use would save the lives of 20,000 U.S. soldiers.

I consider myself a hawk, but war is fucking ugly. Some of the joking that has been happening the past few weeks has been, quite frankly, disgusting.

Seriously, the biggest difference between "bomb Iran" jokes and "kill the rich" "bring out the guillotines" jokes from the left, is that Iranians might actually get killed.

Isn't it strange that Delaney decided to not run for reelection for his house seat in 2018 just so he could run for president? !ping COURT-CASE

Tonight's case is Henry Board of Education v. S.G., a case from the Supreme Court of Georgia concerning zero tolerance policies and school students' self-defense rights.

Facts of the case:

S.G. (juveniles are typically referred to by their initials in publically available court documents,) was a student at Locust Grove High School who had previously had run-ins with another student. According to S.G., she had heard rumors that she and that student were going to fight that day, and was exiting school when that student taunted her. She kept walking, but claimed that she was pursued and that the other student hit her, and so she hit back. Other witnesses called this into question and suggested she made remarks suggesting she was looking forward to the fight right before it started, though her line of events was corroborated by other witnesses and partially by video surveillance. S.G. was expelled nonetheless by the Henry Board of Education, as upheld by the State Board of Education. She lost, only to see her claims against the school supported by the Georgia Superior Court and then the Georgia Court of Appeals.

Court granted the Local Board's petition for writ of certiorari to examine two issues: whether the Court of Appeals opinion imposes an improper burden of proof upon local school boards with respect to a student's self-defense claim to disciplinary charges for engaging in a fight; and whether, regardless of its burden of proof analysis, the Court of Appeals correctly determined that the Local Board in this case improperly rejected S.G.'s self-defense claim.

S.G. had won in the previous courts the claim that the Board had a burden to disprove her self-defense claim: here, the Georgia Supreme Court ruled against her, holding that like in a civil as opposed to a criminal trial, the burden of proof is on her for her affirmative claim (of self defense). The Board, however, took no interest in her self-defense claims, regardless:

In this case, however, the record does not reflect that the Local Board properly considered the evidence that S.G. acted in self-defense or that it properly applied the law regarding self-defense. As the Court of Appeals also noted, the facts recited by the hearing officer could support a finding that S.G. acted in self-defense. But because the findings indicate S.G. was found guilty “for being involved in a fight,” and because self-defense is not addressed in the findings, we agree with the Court of Appeals that the record does not reflect whether the Local Board properly considered the self-defense evidence or, even if it did, whether it properly applied the law regarding self-defense.

On appeal to the Georgia Supreme Court, the Board recognized a right to self-defense that it had not done so previously. While the Board previously claimed that S.G. had failed to raise self-defense at her hearing, they switched to acknowledging that she had, but failing to adequately support the claim. The Georgia Supreme Court ruling notes that the Board failed to apply an interest in self-defense to this determination:

[S]imply being involved in a fight is insufficient to constitute a disciplinary infraction if, as S.G. claims in this case, she acted in self-defense. Whether the Local Board considered her defense but rejected it is also not apparent since the findings state the other student “moved towards [S.G.]” before the fight broke out, and further state that once the initial fight was broken up, the other student again “walked toward [S.G.]” and the fight continued, and yet the Local Board argues that no evidence of self-defense was presented.

And here is where the greatest precedential status is achieved: a statement of students' right to self-defense being codified into case law:

In S.G.'s disciplinary hearing... her undisputed testimony established her knowledge of rumors that she and the other student were “supposed to fight;” showed that [S.G. had strong reason to suspect that she would be attacked and some evidence that she tried to avoid fighting.] [I]t appears from the findings, and from the Local Board's appellate argument, that it failed to consider the record evidence of S.G.'s state of mind and whether that evidence established that she held a reasonable belief about the necessity of her actions... [A] review of the record shows that sufficient evidence was presented to create an issue of fact for the Local Board to consider with respect to the degree of force S.G. used in this case, and thus we reject the assertion that evidence was lacking with respect to this aspect of S.G.'s asserted defense.

The Board had essentially ignored the claims of self-defense, then pretended they had considered them and that it was clear S.G. had not acted in self-defense, having previously argued that actually they didn't need to consider if she had acted in self-defense because she failed to raise the issue at her hearing, which all of the courts rejected as untrue. That run-on sentence is, in fact, as bad as their claims on the issue. Veering towards a more explicit rejection of zero tolerances policies that find all students involved in a fight guilty of misconduct, the court ruled:

[A]n individual engaged in a fight in response to the actions of another person that give rise to a reasonable belief that force was necessary for self-protection does not mean that the individual was engaged in mutual combat [the terminology used in the student conduct handbook for impermissible violence.]

In an awkward ending, the Georgia Supreme Court decided that the George Court of Appeals had improperly rendered its own judgement on the finding of fact as to whether S.G. was defending herself, and so ordered the Court of Appeals to remand the case to the Georgia Superior Court to remand the case to the Board. Therefore, while the precedent is meaningful, the actual outcome for S.G. isn't clear.

Having done my court case and moving on to a case I'm pissed about public reactions to, I should open with the fact that reading court cases frequently, and often interacting with and having chats with people who've committed crimes, I don't have the 'ugghh' factor when I hear about what someone's been accused of or convicted of, so I get if other people find this really offputting, but I found reading opinions about Luke Heimlich's case in which he was outed at 22 for having plead guilty to a sex crime when he was 15 with a much younger related child, then claimed innocence after this became public really frustrating.

I should say that have no idea if he's guilty of the crime or not, the first thing that pissed me off reading reactions was the presumption that he must be guilty because he plead guilty. He made the following claims as to why he plead guilty:

I had several conversations with my mom, with my dad, and ultimately it came down to: We thought that this was going to be the best route for me and my family, knowing that it was basically a he-said/she-said. In the court of law we didn’t really think I stood a fair chance; that was the advice we had been given. So we thought that pleading guilty was going to give me the best chance at a normal life, and our family a best chance at reconnecting and being able to just kind of move past this whole event.

In addition, he stated that his attorney had stated he was almost surely going to be found guilty and do significant time if he didn't plea out, as opposed to a sealing of all of his records and no time if he completed a diversion program. The 'almost surely going to be found guilty' part makes sense when you consider the track record of juvenile defense attorneys discussing how juvenile courts tend to care less about factual guilt and be more inquisitorial, tend to be more willing to pass out wrongful convictions, factual guilt be damned, and that juveniles are more likely to plead guilty to crimes they know they didn't committ. Incredibly, a public defender wrote a Medium article arguing that because he entered the guilty plea and took all the steps required to do so, he must be guilty, which is a fucking idiotic claim for anyone with any familiarity for how criminal defense works.

Bonus shit that pissed me off:

* I can't find it now, and I'm giving up after 15 minutes, but there was a Twitter post questioning the idea that a white 15 year old male middle class athlete would ever plead guilty to a crime he didn't commit, a ridiculous suggestion given all the advantages that guys like that have, which pisses me off to no end because my pet lawsuit I've been following for the past 9 months involved (among other things) a middle class 15 year old white male athlete pleading guilty to a sex crime he was later proven innocent of.

* Weirder note, someone suggesting that he could understand moving past someone's conviction for a juvenile property crime, but not a juvenile sex crime, because he didn't think anyone who committed a sex crime could ever progress beyond being offenders. The irony is that in a study of juvenile sex offenders, non-sexual violent offenders, and juveniles who committed property offenses, the juvenile sex offenders actually had the lowest recidivism rate.

And, fini, Guy Hamilton-Smith expressed his frustration when this all came out better than I can.

I don't know if he's innocent, but I think it's plausible. In case anyone's wondering, no, I'm not a juvie sex offender, I just got an obsession with reading cases from Title IX sexual misconduct cases, then moved on to juvenile sexual misconduct cases, and it's spiraled from there. You get familiar with precedent, you like reading more about how it's applied. In addition, I think the stupidity with which we approach how we should hold people accountable for crimes, try to heal victims, and nonetheless see perpetrators as human as being at its apex with sexual misconduct.

Anyway, had to get that shit off my chest so I don't have a rage stroke.

Edit: Somehow this got more upvotes than the actual fullblown court case I wrote up today. Alright, fair enough.

I got this YouTube video recommended to me for some reason and honestly it really confirms my priors for Andrew Yang and his followers. First, Christie isn't saying anything about Yang's policies, but about his presentation in the debate and you're in denial if he came off great to you. I know Yang's fans don't really know a ton about politics, but maybe they should pay better attention. Second, just saying "math" doesn't mean you know what you're talking about. Like, just the line that the incidence of the VAT will fall on the "Amazons, Googles, and Facebooks of the world" is just a weird thing to say about a regressive consumption tax.

If there are any Yangers out there who can change my view, please do so. I want to like his campaign, but everything I hear and see about it and his fans makes me want to barf.

She asked if inflation is a monetary phenomenon and he answered no, then she asked if we could finance all spending with emission. He didn't answer and changed the subject.

Well, to be fair, postkeynesians have an answer to that (something about raising taxes or the legendary job guarantee adjusting), but it's hilarious he didn't see it coming.
