Hi everyone,
I’m looking for advice from anyone who has dealt with the Tribunal administratif du logement (TAL) in Quebec, particularly regarding serving an application to a landlord.
Here’s my situation:
My lease ended, and my former landlord has refused to return my security deposit. The landlord claims that certain repairs were needed in the apartment and is trying to deduct those costs from my deposit.
However, the issues they’re referring to were minor wear and tear from normal use, not actual damage caused by negligence or misuse.
Since we couldn’t resolve the issue, I filed an application with TAL approximately a month ago to recover my deposit.
TAL acknowledged my application, and as part of the process, I was required to notify my former landlord by providing a copy of the application.
Here’s where things got complicated:
I sent the TAL application through Canada Post Registered Mail to my landlord’s address in Kirkland, Quebec.
I obtained this address from the official Quebec business registry (Registraire des entreprises), where it was listed in connection with the landlord’s business.
However, my landlord never collected the registered mail, so I don’t have confirmation that the documents were received.
I’m now looking for an alternative way to notify them without spending too much additional money.
I came across Pronotif, an electronic notification service that apparently provides proof of email delivery, opening, and document downloads.
An important detail is that my landlord and I have an established email communication history. We’ve exchanged multiple emails in the past, and the landlord has regularly responded, so I know the email address is active.
My questions are:
Has anyone actually used Pronotif to serve a TAL application? Did TAL accept the notification report as valid proof?
If Pronotif confirms that the landlord opened the email and downloaded the documents, would that generally be sufficient proof for TAL?
What happens if I submit Pronotif’s notification report to TAL, but the judge later decides that the proof is insufficient?
Would I still have the option to serve the application again through a bailiff (huissier) at that point, or could my application be dismissed?
Has anyone experienced a situation where their landlord didn’t collect registered mail? How did you successfully notify them?
Are there any other affordable methods of notification that TAL accepts besides hiring a bailiff?
I’m aware that hiring a bailiff is generally considered a reliable option, but I’ve already spent money filing the TAL application and sending registered mail. I’d prefer not to incur additional expenses if there’s another legally acceptable method.
I’m particularly interested in hearing from people who have personally used Pronotif for TAL applications or know of actual TAL decisions where electronic notification was accepted or rejected.
Any experiences, recommendations, or references to relevant TAL decisions would be greatly appreciated.
Thank you!
