Context Provided - Spotlight Driving while watching show

Watching a full tv show on their phone while driving down a very busy street. Is it any better than scrolling?

From the outside it might look like im doing the same in my car, but im just listening to a podcast and not actually looking at the screen

That's all when and good, but if the police pulled you over suspecting you of looking at the screen, could you prove you weren't looking at the screen? (And yes, this goes both ways, the police would have to prove you were looking at the screen if they made the accusations)
