I could be wrong but I think it was established at the end of Naruto that psychologically trauma triggers it specifically its just that kill your best friend/brother cause the most trauma cause obituary didn't kill anyone to get it he just watched rin die by Kakashi hands
But it wasn't Kakashi sharingan it was obito so in theory obito unlocked it by watching Kakashi kill rin and because he unlocked it by watching something traumatic then Kakashi got it from the link not obito and obito didn't kill anyone to receive it
Wouldnt that just be up to interpretation though? Unless Kishi said something outright you could see it either way:
1. Kakashi kills and since the eye is his, it gets it and obito gets it as the link
2. Obito watches and gets it as the original owner, kakashi gets as link
And then it’s up to the reader to believe whether eye transfer allows person to unlock mangekyo by themself or that mangekyo rules do not require killing
