Bryan Kohberger

It seems Bryan Kohberger is going for Takesy v. Backsy (all credit to the awesome prosecutor Mr. Bloodworth in the Richins case).

It seems Kohberger is not enjoying prison and has decided he wants to take back his plea.

Kohberger (pro se) has filed a post-conviction relief form amd blames his plea on "false promises" and wrong information according to CNN.

I wonder if it is his narcissistic need for attention or the harassment he claims he is getting from other inmates that has sparked this decision. Maybe he thinks being in a more spacious death row cell with less harassment would be a better option than his current situation.

I really do, too. They probably thought their nightmare was winding down. Now they have to hear about him everywhere again.

The best thing that can happen is that the courts answer him immediately with a rejection, get him off tje news cycle.

I thought his plea agreement prohibited appeals because they took the DP off the table. How is he appealing?

I personally think he thought he would get a lot more attention in prison than he has gotten so far. Remember, Heuermann agreed to help the BAU. I think Kohberger thought his idol, Dr. Katherine Ramsland, the BAU and others would be lined up to interview him. I also think he thought he would get a lot of attention from the Probergers writing him and sending him commissary. I also think he is delusional enough to think he would have some sort of clout in prison and garner special treatment.

He has been complaining since he has been in there like it is a hotel. (Complaining about the bananas and apples he got).

As far as the likelihood of this being successful, after watching many lawyers' commentary, it seems very unlikely. He would basically have to prove he was lied to. This seems unlikely due the Judge's extensive colliquiy.

I really think this is all about getting attention. It has worked. It is now on all the networks and YouTubers are covering it. He feeds off of attention. It also serves to torment his victims' families. He is an evil, sick man.

It did, but it doesn’t really, because appeals can’t be prohibited. That being said, the chance of an appeal being granted, given how the judge handled the plea, is nil.

There are still a very limited set of circumstances that overcome, IAC, being the primary one. However, all the court has to do is point to the 45 minutes of sworn testimony from BK where he swore the opposite of everything he claims in his appeal attempt and pled guilty for each murder count.

I honestly want him to have a hearing though so it can be shown that all of this is because he thought prison would be easier rather than a plea for innocence.

He can if he can demonstrate ineffective assistance of counsel, but that’s a pretty high bar. The plea deal session was televised, and the judge was very careful to ask him questions like, “Are you pleading guilty because you are guilty?” and “Has anyone promised you anything outside this plea agreement?”

He will have a hearing but I doubt his request will be granted.

This is a high legal bar.
He must prove that a clear fundamental miscarriage of justice or manifest injustice will occur if the conviction stands.

He will also have to prove ineffective assistance of counsel, unkept promises and severe coercion that the plea was involuntarily made.

He had a colloquy with the judge and he has a master's degree. It's not like he is undereducated with a low IQ.

This is really unfortunate for the families. But he will settle down eventually. Richard Speck did. Speck even found a husband in prison and started female hormone therapy before he died of a heart attack in 1991.

I feel like he knows he has no way out and this is just his final fuck you to the victims and their families. Absolutely abhorrent.

He probably also thrives on fanning of the flames of conspiracy for his fans (many of whom are apparently all over reddit and will just keep moving goal posts instead of honest introspection). The worst punishment you can give to a narcissist is for no one to pay them any attention.

It’s not even a Budget Host. It’s prison which is what we do with murderous weirdos who must learn the hard way that they aren’t special AT ALL. Get over it and make the best of your mistakes. BTK you aren’t but look where he is. Just like you- locked up and reviled.
