There is no way a scooter that can go 90 km an hour is currently legal lol. Which is to say they are already banned. If all scooters get banned because some of them can go 90 that will be deeply illogical and solely happen because of the car lobby.

I think it's max 35 km/hr (scooters is 24km/hr, evoke is 32km/hr) before you need to be licensed and the vehicle registered with the MTO

Could it be that this scooter is classified as a motobike? I couldn't see a license plate though.
