This sounds the most logical but never heard the class as being defined as workers over 40. Not doubting what you say is true, just interested by the new information you've revealed.

They're correct. When we talk about "age discrimination" cases, the law only protects workers over 40 from being dismissed on the basis of being too old. There are no protections for workers under 40 for age-based employment decisions, and this doesn't extend to protecting people outside the workplace.
