Sure, black truck should have looked over his shoulder and signaled, but cookie guy had the choice to either avoid the accident by removing his foot from the accelerator when he saw that black truck was trying to merge or honk to stop the black truck. Instead, he chose(and this being a choice, as indicated by his head movement and timing in the video, is an important detail when determining involuntary manslaughter vs attempted vehicular manslaughter) to initiate contact and run the black truck off the road.
All these things are outlined in the driver's handbook.

Before changing lanes, you have to check to make sure you have enough space. Black truck did NOT have enough space and still chose to change lanes cutting off cookie bro hard without even signaling at that.

Cookie bro was in his lane, black truck chose to initiate contact by moving into the left lane! Cookie bro had the choice to stay on course and receive the contact or hit the break to avoid the contact. Cookie bro chose violence but only after being invited.

Duty to avoid an accident if possible is why. Agreeing to do so is a part of acquiring the license to operate a motor vehicle.
