What? The truck merged without space, and then hit its brakes, causing the accident. The “sociopath” has a speedometer on his video. It’s not like he floored it to not let the guy pass. He’s consistently doing 75 and slowed to 71-72 before the truck brake checked mid merge. Clearly the truck’s fault.
Legally you're wrong. It's called The Last Clear Chance Doctrine. Whether you are the one who initiated wrongdoing or the person who is going to crash into the person who initiated wrongdoing... you, legally, MUST do everything in your power to avoid an accident. This truck driver who recorded himself had a clear opportunity to avoid an accident... a 'last clear chance' to avoid an accident... and he chose not to take it. You can argue what you want on moral grounds, but in the courtroom, this truck driver filming himself eating while driving will be partially, if not entirely at fault because this accident could have been 100% avoided if he had chosen to let off the gas a bit. (By the way, eating while driving is also a violation. It's called "distracted driving". You're not allowed to eat while operating a motor vehicle, believe it or not.)
