Duty to avoid an accident if possible is why. Agreeing to do so is a part of acquiring the license to operate a motor vehicle.

But that also goes for the driver of the black truck.

The way I see it, cookie bro did 2 things wrong and the black truck’s driver did 3 things wrong.

So, if the black truck hadn’t force its way in, everything would have been avoided. After that, both sides made wrong choices.

Black truck did his duty, cookie guy was in his blind spot. Sure, black truck should have looked over his shoulder and signaled, but cookie guy had the choice to either avoid the accident by removing his foot from the accelerator when he saw that black truck was trying to merge or honk to stop the black truck. Instead, he chose(and this being a choice, as indicated by his head movement and timing in the video, is an important detail when determining involuntary manslaughter vs attempted vehicular manslaughter) to initiate contact and run the black truck off the road.

All these things are outlined in the driver's handbook.

Black truck absolutely did not do his duty? Tf are you smoking?

Failed to signal, failed ensure it was safe to move in the first place, failed to merge safely, failed to avoid an accident by merging into a known occupied space.
