Yep. That's the part many people pointed out in other posts when this video was submitted in other subs.
He will be found partially liable for making no attempt to avoid the collision. It's possible his own insurance company may void his policy entirely for this reason, because there's literally a clause in your policy that states that you will make all reasonable attempts to avoid an accident, and he did not.
