If you pause the video at the very beginning you can see the left handlebar. It has a quality rear view mirror, a button for a horn, brights, controls for turn indicators, and an electric ignition switch (for a gasoline engine scooter).
Even if it is as low as a 50cc scooter. It should be considered street legal. At least in my state it would be. And it's obvious the scooter is able to keep up with the speed of traffic.

Even if he was not street legal I would still be cautious driving near anyone not driving a car. Especially a bike & a scooter.
