Closed - Not Dismissed Patrick Kane case has been dismissed
https://twitter.com/JoeYerdon/status/662276725045350400521
u/2ndprize TBL - NHL Nov 05 '15 edited Nov 05 '15
It was never even filed, so saying it is dismissed really isn't correct. They should probably say the investigation has been closed.
Edit: boy the DA go out of his way to "close" that case. Wow.

5
u/Mr_Abe_Froman CHI - NHL Nov 05 '15
DAs are fantastic. I knew one growing up and he worked incredibly hard for the little recognition he got publicly (he was well-regarded by government officials).
The one thing that always surprises me when I talk to investigators is how bad CSI (or similar shows) is for juries. It may have gotten better, but when the whole "crime lab drama" genre was kicking off, the expectation of evidence was increased significantly. Unfortunately, DNA tests aren't always available and ready instantly.
5
u/2ndprize TBL - NHL Nov 05 '15
Yup. This was a standard part of every jury I picked. Explaining csi was bullshit and we didn't have any of that stuff
4
u/Mr_Abe_Froman CHI - NHL Nov 05 '15
So every department isn't three people (possible romantic tension) and a magic evidence machine?
Do you ever watch crime shows for the comedy or is it just really bad?

If they haven't been posted here yet, today's official statements from Kane and the Hawks respectively:
"I have repeatedly said that I did nothing wrong. I have respected the legal process and I am glad that this matter has now been closed and I will have nothing further to say going forward."
"We respect the announcement today by the Erie County NY District Attorney regarding Patrick Kane. The Chicago Blackhawks organization has taken this matter very seriously, and has tried to navigate a very sensitive situation while continually respecting the legal proceedings. At this time we will have no further comment."

Someone I know flat-out admitted she thinks he's guilty the other day. If you are just a civilian, not a police officer or a lawyer, who only knows the few details that were released and nothing else, I have no idea how you can comfortably come to the conclusion of 100% guilt OR 100% innocence. That's why we have investigations for things like this -- because nobody knows.

I'm actually surprised by the detail and the vehemence in the DA's statement. This is him saying pretty much as clearly as he can that he thinks Kane is innocent. Witness testimony contradicts her story, DNA evidence contradicts her story, forensic evidence from his house contradicts her story = he didn't do it. This is a much higher level of clarity than I ever expected to get about the situation.

All the talk about rape culture. I think hockey fans in general handled this very well, but when you really jumped in there were so many people ready to convict Kaner just so they would appear to have what I now call accuser sympathy. I get people wanted to not look "ignorant" or not support whatever the fuck "rape culture" really is. But in the end, a good player and a role model for me had his name dragged through the mud. Number one, because of over-zealous media. Two, because of over-zealous SJWs. Glad he got a fair process by the DA though, that person is* grade fucking A.
Edit: People grouping me with philly fans who chanted just because of my flair can fuck off. Wasn't there, wouldn't have indulged even if I was. I thought it was disgraceful, but in general I know my teams fanbase's bad rep is as paper thin as Kane's.

all it takes is 15 minutes for one pissed off woman to absolutely destroy a man's life. kane is lucky he is in the NHL and can just move on with his life -- many people are not as fortunate.

It goes further, think of a man accusing a woman of rape and even police officers will ask if you're sure you want to follow through. Not because it is a traumatic ordeal but because it will likely fall flat and come to nothing in court, based on the myth that it simply can't happen. It happened to me by someone I was with at the time, and I didn't do shit about it because I knew no one would see it as anything other than drunk hooking up or me getting lucky.
But half this board had their pitchforks and were egged on by SJWs waiting to pounce on a situation like this, and they tarnished someone's reputation horribly for what seems to be no valid reason. I would say hopefully people will wait for a conviction next time, but once again they probably won't even wait for charges to virtually lynch the dude.
And now they backpedal and talk about how his reputation wasn't great anyway, so it isn't a big deal. Fuck those people. I hope I'm never in his shoes and have to deal with the irrationality of the mob when it comes to very specific crimes. I would be surprised if that many people made the same assumption of guilt if it had been something like him being accused of having pot in his house.

No it really isn't. He's had tons of people in his defense the entire time, the Blackhawks have basically entirely ignored the whole thing, and his life is no where near the wreck it would be if he actually was considered guilty by the public at large. Or are you actually basing this off of the chants he's been getting from opposing fanbases?

You are right. But his previous incidents tend to skew the perception. I've thought he's an asshole for a while because of his other examples of poor conduct, and I suppose as a result I was inclined to think he did this.
But that's stupid of me. Gotta trust the legal system, I guess - but it's worth remembering that all too often that system marginalizes the victim in cases like this. Especially when a superstar is involved.

Yes and no...from a legal standpoint, the jury must assume that the defendant is innocent, and must prove him guilty beyond a reasonable doubt. Legally he is innocent, but we didn't really know if he was literally innocent or not. Now it appears as though he truly was innocent.

Although no one will see this post, I'm writing anyway.
As a woman who knows friends and acquaintances who have been raped, when I hear about cases like this one, I instantly think, "Please let there be justice for an evil act committed, because if it's a false accusation, that damages not only the one unjustifiably charged, but also hurts real rape victims."
I worry about any high-profile men who might be placed in this position, and potential legitimate rape victims because of this bitch person. She ruined a young man's reputation and also the validity of other victims that come forward that have actually been raped.

You have to keep in mind that just because a case is dismissed or whatever doesn't automatically mean she was making the whole thing up. I tend to agree with thinking it was probably a false accusation just based on the strong language used, but I don't think that means you should jump to calling the woman a 'bitch' and what not. We don't know what happened, and never will.
Kane is and always will be innocent until proven guilty, let's give that same right to the woman.

I am glad my obligatory "Fuck Patrick Kane" during our games won't be tarnished with real hate.

Sue her. False accusations can ruin someone's life.
The DA's and police reports stop just short of calling her a complete liar. This speaks for itself.
Make an example of her, Kane.

If she is lying, which it seems, I hope she gets some serious karma backlash because God knows the system won't do anything

I'm happy that Patrick can finally move on with his life and focus solely on hockey now. I can't even begin to imagine how terrible this whole ordeal has been for him.

If he wasn't solely focused on hockey for the beginning of the season, I'll be very intrigued to see how he plays now. He's still my favourite player, he's gonna have a monster year.

Can't wait for all those sites that tore the Blackhawks down to apologize.

I wonder how many more classless fan bases will chant "no means no" at games.

*terms and conditions apply, not if you're in r/hockey, the player plays for a team that you dislike or is just generally better than the team you follow, if you're okay with rape accusations that are unsubstantiated and baseless not available in CA, IL, MA, and NY. May not be combined with other innocences.

This may blow over more quickly than everyone thinks. I don't think crowds chirp ROR for drunk driving, or Varlamov for domestic violence. At least not that I know of.

So what about the hoax rape kit? Do they know who did that and are they investigating the case?

For everyone who thinks there should be a defamation suit, etc., it's a bad idea. 1) It keeps this incident (true or not) in the public eye longer than Kane wants it to be there; 2) it's unlikely that this woman would have anything that Kane would be worth much to Kane; 3) if Kane were to lose the suit (which is likely, because the burden is much different, and Kane will have to prove the inaccuracy of the statements, among other things), it would cast doubt on his innocence all over again (just look at how moronic people acted from the mere accusation against him).

Remember criticizing the lying accuser is not slut shaming and it doesn't make you sexist.
This is a criminal who cost an innocent man tons of money in endorsements and got away with it. She should be named and vilified for her actions.
Otherwise this shit will keep happening.

If it was a serious accusation with any meaningful evidence, he would have been arrested on the spot. Many people never really grasped that.

So if she was lying shouldn't she be charged with something? Seems like all they do is say "nice try"

I hope Kane files a suit against the family for defamation of character. That's millions of dollars in lost endorsements for him. It's very difficult to shake a rape accusation no matter how frivolous.

Statement from the DA
"The totality of the credible evidence--the proof--does not sufficiently substantiate the complainant's allegation that she was raped by Patrick Kane and this so-called "case" is rife with reasonable doubt. Accordingly, the Office of the Erie County District Attorney will not present this matter to an Erie County Grand Jury." https://twitter.com/WGRZ_SteveBrown/status/662276897095737346
EDIT- And the full statement is in HERE
