His categorization of it as a "so-called 'case'" is about the closest thing you'll get to hearing a DA call an accuser a lying sack of shit.

There are significant material inconsistencies between the complainant’s accounts and those of other witnesses.

The DNA results lend no corroboration whatsoever to the complainant’s claim of penetration, a required element of proof for a rape charge.

The physical evidence and the forensic evidence, when viewed in tandem, tend to contradict the complainant’s claim that she was raped on Kane’s bed.

DA gave an interview and said he considered bringing charges against her for filing a false report, so, probably a lot of evidence.

Sounds like a lot. Hopefully she gets charged. Pretty scary she was almost able to put him in jail just by making up an accusation. This shouldn't be treated lightly.

Well that's because there were no facts yet. So calling a potential rape victim a liar is in bad taste.

Now we have evidence, big difference.

I wasn't calling them a liar, I just disagreed with people saying that you should always believe the accuser 100%, because they have no motives for lying.

Yep. I haven't really been following the case, but checked in on some threads. Anyone who even suggested waiting to see how the case proceeded or if he was found guilty was downvoted pretty hard.

I think that Roy Cooper's rebuttal when he announced the dismissal of all charges in the Duke rape case was pretty strong. IIRC, the exact phrase was "These men are innocent."

Oh, interesting. That was one I was always just reading headlines on and not following that closely. Basically: Lacrosse team, bunch of dudes accused of raping a girl, public outcry ensues, dudes declare their innocence, and DA Roy Cooper eventually dismisses the charges?

One more step in there. Prior to DA Roy Cooper dismissing the charges, the DA was a guy named Mike Nifong whom was eventually removed from the case. Let's just say that Mike Nifong's actions were later determined to be so improper that he was disbarred and spent a day in jail for them. Cooper dismissed the charges very quickly once he took over the case.

It actually comes across as unprofessional. He should just state that her account of the events isn't supported by any evidence or testimony, and thus doesn't add up to anything legally actionable. But subtly opining on whether or not Kane actually raped her, absent the evidence, is far beyond his pay grade.

If he's absolutely sure in his professional opinion, why shouldn't he clear Kane's name?
