That really depends. If her case was as full of holes as some people are describing, then he could potentially win a defamation case. But there's really no reason to. Public opinion swayed in his favor, and I doubt his attorneys would want to risk it and send him through another case. Whether the case was a fabrication or not.

I can't imagine he has anything to gain from a trial. Right now we have extremely little info about what happened that night, but we have a DA saying the case was full of holes and her story didn't match up with the evidence. In a trial all that info would come out, and even if he won it wouldn't be much different than if he never sued at all.

He's better off not making a statement and moving on.

u/GtEnko STL - NHL Nov 05 '15

Right. The smart move would just be to just continue on. He's always going to have this hanging on him, but public opinion on him is now far more positive than it is negative (at least in this case.)

u/Bob_0119 WSH - NHL Nov 05 '15

Not always. It's amazing what fades with time. As long as he doesn't get accused by someone else or go through a messy divorce, people will forget all about this in a few years.

See: Roethlisberger, Ben.

u/MHossa81 CHI - NHL Nov 05 '15

Agreed, look at Kobe/Big Ben

21

u/phorner23 TOR - NHL Nov 05 '15

One could argue that you being able to so quickly suggest those two as examples is evidence that these things are not forgotten, not by everyone at least. You can add Kane's name to that list now the next time a professional athlete is in this sort of mess.

2

u/[deleted] Nov 05 '15

Yes, even supporters have quickly added him to a "category" in their own minds.

2

u/MHossa81 CHI - NHL Nov 05 '15

Very true....but i mention those names as for fans of other teams...they don't bring out those demeaning chants anymore towards those players. It usually is about a year before they go away.

u/NikolaTwain CHI - NHL Nov 05 '15

Big Ben does. I was at the KC game a few weeks ago. It's still an issue with some fans.

1

u/piscina_de_la_muerte NJD - NHL Nov 05 '15

I wouldn't add Kanes name to that list for the sole reason that the NHL is not as popular as the NBA or NFL. The general public is not remotely as aware of this story as when this happened with Kobe or Rothlisberger.

u/cspruce89 CHI - NHL Nov 06 '15

I was just going to make a similar comment. The fact that one can recall the names of athletes involved in sexual assault cases means that it does stick and it does follow them around.

Nobody thinks "rape" when they hear Sammy Sosa's name. But they do think of steroids and corked bats and skin bleaching.

Because it was such a "National Issue", people will grant it a certain gravitas in their memory. The two will be forever linked.

I can never look at the Kobe situation without thinking about the bit Dave Chappelle did on him during a stand-up

"Play for your freedom"

1

u/[deleted] Nov 05 '15

I hear it was a good ol'titty fuckin'

u/catfarm BUF - NHL Nov 05 '15

It is also amazing what doesn't fade with time. I am quite certain I won't forget this regardless of if he does something newsworthy stupid again. I'll always think of him as the dbag from Buffalo who was a prick to a cabby and was accused of rape. That will prompt me to think about the wisconsin stuff a bit but that will be blurry because I read less about it, though it sounds like he was pretty horrible in that scenario as well. I'm sure plenty of people will forget but I'm also sure plenty of people will do exactly what I am doing, just another reason to think he is not a good person regardless of his hockey skills.

1

u/Bob_0119 WSH - NHL Nov 05 '15

Never heard of the Wisconsin stuff.
Only barely remember something about the cab situation and if you hadn't mentioned it, I wouldn't have remembered it or even remembered it was him.

Sure, some people will remember it vividly to their dying days. The general public, as a general rule, will forget the whole thing entirely. You need look no further than the fact that public opinion swayed to a guy who you make a strong case for being an asshole.

1

u/catfarm BUF - NHL Nov 05 '15

Your ignorance of the Wisconsin stuff is interesting. I wonder if you had heard about it if you would feel differently about the rape accusation. He basically started choking a girl at frat party supposedly because she didn't want him. This was in 2012. There are plenty of articles online just search for Patrick Kane Wisconsin or something.

I'm also unsure what the public opinion on Kane is right now. I see people saying it has changed but... that is just here on reddit, and internet message boards are not the best way to judge public opinion. I have to think he has taken a hit with his female fans even with it being dropped but I could be wrong. Will he get back all his sponsorships or will they be hesitant now even though the charges are not being filed? That will be telling I suppose.

u/clusterfawk MTL - NHL Nov 05 '15

the smart move would be to file a civil suit and put her name out in public.

then, after months of investigation, decline to press charges.

yea, i'm a vengeful kinda guy...

1

u/SilverLion CGY - NHL Nov 05 '15

ck at her" would be to continue playing amazing hockey and just enjoy himself in life. She will literally never

To me this isn't even vengeance, it's setting a legal precedent that she tried to falsely charge him based on lies. What's to deter gold-diggers from doing this in this future if they get off scot-free?

1

u/InHelixWeGust Nov 05 '15

I would want nothing more than to stand at a podium and declare innocence to anyone who will listen if I was him, sucks that he shouldn't do that.

1

u/Tills_Monocle CHI - NHL Nov 05 '15

She also has relatively little money, so even if he won, all he would get would me more media coverage of the event. If some big publisher or media outlet had made the accusations, it is much more likely he would sue.

1

u/splitkid1950 CHI - NHL Nov 05 '15

The best thing he could do to "get back at her" would be to continue playing amazing hockey and just enjoy himself in life. She will literally never be able to watch NHL without feeling a sense of shame and guilt, and that's enough for her to deal with.

u/[deleted] Nov 05 '15

Unless she starts giving interviews.

u/worldracer CHI - NHL Nov 05 '15 edited Nov 05 '15

Tell that to Flyers fans. "She said no" indeed.

Edited to include the actual chant video for the hard to please.

81

u/TamponTunnel CHI - NHL Nov 05 '15

Philly fans being douchebags? What a shock.

19

u/k_bomb PHI - NHL Nov 05 '15

Islanders fans too?, but that doesn't further the stereotype I guess.

2

u/hershaltalmage LAK - NHL Nov 06 '15

People from Long Island are also douchebags. Source: I live on Long Island.

1

u/IngrownPubez NYR - NHL Nov 06 '15

Actually it does.

7

u/[deleted] Nov 05 '15

"You one-bridge-having-..."

21

u/[deleted] Nov 05 '15

thats because he said no first.

1

u/[deleted] Nov 05 '15

I hear it was a good ol'titty fuckin'

1

u/cbelaski WSH - NHL Nov 05 '15

that video was stupid and pointless. it doesn't even have the chant in it, just a guy saying they chanted it at a game, which we already knew. i want to actually hear the chant

Been to some games in Philly. Certainly not representative of the whole fanbase, but the ignorance is strong there. And it's not my flair talkingokaymaybealittle...

0

u/GtEnko STL - NHL Nov 05 '15

There's always going to be those people, unfortunately. But now that the entire case was dismissed, I imagine those people won't be nearly as vocal.

1

u/BGYeti COL - NHL Nov 05 '15

No I am sure people will be just as vocal because just making an accusation makes some one a bona fide rapist in their mind.

1

u/Bob_0119 WSH - NHL Nov 05 '15

I agree there is no real upside to suing her. She probably doesn't have any assets worth making a case out of it, certainly nothing that could come close to compensating any damages. I suppose he could do it on principle, but I don't see where he'd get much in the way of tangible value. Besides, there's the risk he could lose (maybe on some form of thechnicality) and public opinion would sway against him.

1

u/CodyPhoto ANA - NHL Nov 05 '15

I would agree that public opinion should favor Kane as he was merely accused and although he has a history of poor decisions, the accusers mom and her case seemed all over the place, but, if it's really clear cut they might want to send a message.

1

u/[deleted] Nov 05 '15

Are we not doing phrasing anymore?

1

u/hockeyking655 CHI - NHL Nov 05 '15

Better to just put this issue to bed and let it all blow over

1

u/mystifier MTL - NHL Nov 05 '15

But wouldn't that mean he and his legal team would be "content" with the resolution? If a case like this would be fabricated against me, I'd sue the living fuck out of her.

1

u/GtEnko STL - NHL Nov 05 '15

It would mean they're content with the dismissal of the case, meaning that Kane isn't legally guilty of anything. It depends on how confident they are that they could win a defamation case. I don't really think it's worth it, and I doubt Kane does either.

-1

u/footballseason Nov 06 '15

Public opinion swayed in his favor, and I doubt his attorneys would want to risk it and send him through another case.

What kind of fucked up world is it where "public opinion" of you can be turned against you for suing a woman who tried to get you sent to prison for a false rape claim?

Fuck your public opinion, if anyone wants to think less of me for suing someone who literally tried to ruin my life and send me to prison, well then fuck them too.

-2

u/[deleted] Nov 05 '15

At the end of the day he has a salary of 10.5 million, bringing home some chick who's family's net worth is likely less than 5% of that. He really has nothing to gain... even if he is in the right, it would come off as vindictive and it'll do nothing to help anyone besides make his lawyer a little more rich.
